최근 국제사회에서는 자유무역협정이 활발히 확산되고 있다. EU는 아시아에 대한 지속적인 관심을 바탕으로 한국과 가장 먼저 FTA를 협상을 진행하였다. 한국은 성장가능성이높은 시장을 가지고 있으며 중국과 일본에 비해 적극적 FTA정책을 펴고 있다는 점이 협상을 가속화하는 주요한 이유가 되었다. EU는 아시아 국가들과 지역무역협정을 추진하는경우 경제적 협력 강화는 물론 정치적 고려도 포함하였다. 본 연구는 무역구제조치, 경쟁법 분야, 개성공업지구 원산지 특례규정과 노동법 이렇게 세 파트로 나누어 법적 과제를검토하였다. 한-EU FTA의 효과는 경제적 측면을 넘어 안보와 외교까지 확대될 수 있다. 양측은FTA와 함께 경제적 이익을 얻고 있으며, 전략적 동반자 관계로 성숙하였다. 국내의 무역구제조치 관련 규정이 매우 미흡하여 개선될 필요성이 있다. 양국 모두 경쟁법 관련 국내법을 이미 가지고 있으나 FTA와 더불어 발전시킬 필요가 있다. 한국은 다른 FTA와 마찬가지로 한-EU FTA에서도 개성공업지구 원산지 특례규정을 포함시켰다. 이 규정이 제대로 활용되기 위해서는 개성공업지구 노동자들의 근로 환경이 개선되어야 한다. 한-EU FTA는 상당히 발전된 FTA의 형태를 가지고 있으나, 국내법의 개선과 조화를 이루며 발전해 나가야 한다.
Abstract
Recently, Free Trade Agreement(FTA) are extremely spreading. Korea is the first asian country that EU started FTA negotiation with constant interest in Asia. Korea is having good future market which has high growth potential. Also, Korea has aggressive policy on FTAs than other Asian countries such as China or Japan. These reasons appealed and EU accelerated to make FTA with Korea. When proceeding Regional Trade Agreement(RTA) with Asian country, EU included not only strengthening economic cooperation but also regarding political consideration. This study examined legal tasks in three part on trade remedies, competition law,and rules of origin and labour law on Kaesung industrial complex(KIC). The effect of Korea-EU FTA could expand to even security and diplomacy beyond economic effect. Both parties are getting economic benefits and have become strategic partner. Trade remedy provisions of domestic law are too short thus it is need to be developed. Both of countries has own competition law though, it should be considered further with FTA. Likewise other Korean FTAs, Korea provided rules of origin on KIC in Korea-EU FTA. For the proper use of this provision, it should be ensured and ameliorated the working conditions of KIC workers to the level of ILO with amendment of North Korean labour law. Korea-EU FTA is already quite high standard FTA though, it should be improved further with harmonizing domestic laws.
