거대 온라인플랫폼을 규율하기 위한 사전규제 형식의 EU 디지털시장법(Digital Markets Act)은 사후규제인 기존 EU 경쟁법 체계에 비해 상당한 구조적 변화이다. 본 논문에서는 온라인플랫폼 규제의 주요 배경 이론인 필수설비 이론과 EU의 온라인플랫폼 규제 배경에 대해 살펴보았다. 또한, EU DMA의 실체적 규정인 ①DMA 적용 범위, ②게이트키퍼 지정요건, ③게이트키퍼에 대한 의무, ④DMA의 이행 및 집행을 위한 규칙 수립을 중심으로 주요 내용을 파악하고 몇 가지 쟁점에 대해 비판적으로 고찰하였다. 결론적으로 DMA는 동태적 경쟁이 일어나는 온라인플랫폼에 대한 사전규제의 적절성 문제, 집행위원회와 회원국의 중복규제 가능성, 역내 외 게이트키퍼 규제에 따른 통상 마찰 가능성이 존재할 수 있다.
Abstract
The EU Digital Markets Act, a form of ex-ante regulation to regulate large online platforms, is a significant structural change compared to the existing EU competition law system, which is post-regulation. This paper examines the essential equipment theory, which is the main background theory of online platform regulation, and the background of the EU's online platform regulation. In addition, this paper identifies the main contents of the EU DMA, focusing on the substantive regulations: ① DMA application scope, ② gatekeeper designation requirements, ③ obligations to gatekeepers, and ④ establishment of rules for implementation and enforcement of DMA. Through this, this paper critically examines the main issues of DMA. As a result, this paper found that in the DMA, there may be problems with the adequacy of ex-ante regulations for online platforms where dynamic competition occurs, the possibility of overlapping regulations by the EU Commission and member countries, and the possibility of trade friction due to gatekeeper regulations within and outside the region.
