제품안전 분야에서의 소비자안전관리체계 개선을 위한 현행 제도와 운영실태 분석 연구

본 연구는 우리나라 제품안전 분야에서의 소비자안전관리체계의 제도적 문제점과 체계 작동과정에서의 실질적 문제점을 진단하고 그 개선방향을 모색하였다. 이를 위해 연구는 관련법ㆍ제도의 현황과 역사적 변천 과정을 정리하고, 분석틀을 개발하여 관련법, 관리주체, 관리제도의 측면에서 분석하였으며, 동일한 틀을 사용하여 최근 발생한 가습기살균제 사건과 갤럭시노트7 리콜 사건에 대해 사례분석을 실시하였다. 이를 통해 드러난 우리나라 소비자안전관리체계의 문제점과 본 연구가 제시하는 개선방향은 아래와 같다. 첫째, 우리나라 제품안전 관련법은 법의 제ㆍ개정과 운영에 대한 합의된 방향성의 부재로 법률 간 기능과 역할의 중복, 법률 간 안전관리 품목의 혼란 등의 문제를 유발하고 있었다. 이를 해결하기 위해서는 관련법 전반을 아우르는 통일된 정책적 철학이 마련되어야 하며, 그 방향성이 지속적으로 관철될 필요가 있다. 둘째, 우리나라의 제품안전 관리주체들은 타 업무와의 병행, 관련 예산과 집행력의 부족, 기관 간 공조체계 부실로 인한 어려움을 겪고 있었다. 이를 해결하기 위해서는 제품안전 총괄전문 기관을 신설하고 해당 기관에 대해 예산과 역량을 집중 투자하여 제품별 횡적 안전관리의 한계점을 보완할 필요가 있다. 셋째, 우리나라의 제품안전관리제도는 잠재적 위험 발굴, 시장 감시 및 신속 대응 측면에서 보완이 요구되었다. 구체적으로 원재료의 위해성 평가와 미관리 제품의 안전성 평가 제도를 마련하고, 소비자안전에 관한 종합대응기구로서 소비자안전센터의 제도와 기능을 활성화하여 시장 감시 업무 및 안전사고에의 신속 대응 시스템을 강화할 필요가 있다.
Abstract
This study analyzed critical issues in consumer product safety regulation in Korea with respect to laws, the related institutions charging safety regulation, and its operational procedures in order to suggest alternatives to improve the safety of consumers. To pursue this purpose, this study developed the research frame to analyze current systems and conducted case study analysis on the case of Deaths caused by Humidifier Disinfectant and the case of Galaxy Note 7 Recall. Based on findings and discussions, the following policy suggestions were developed in terms of problems & solutions. Firstly, with respect to product safety related laws, it is suggested to have the comprehensive and consistent safety principle. It is found that there is no consistent principle of safety in the process of enactment, revision, and operation of law. It resulted in duplication of functions & roles among institutions, and confusions in different product control lists according to separate laws. To solve this problem, the comprehensive policy principle embracing related laws is needed and this principle is needed to be consistently applied. Secondly, with respect to the product safety authorities, it is suggested to establish the proper institution to deal with consumer product safety issues comprehensively. It is found the authorities are lack of budget and execution power, and there is poor cooperation system among authorities. For this matter, the proper institution with enough budget and executory power is needed to watch over safety issues throughout consumer products related authorities to supplement limitations of product-specific horizontal safety management system. Finally, with respect to product safety management system, it is needed to be improved in the process of identification of potential risk, market surveillance, and quick response. Risk assessment of raw material and safety assessment of uncontrolled product should be introduced. And market surveillance and quick response can be reinforced by vitalizing role and function of Consumer Safety Center as an independent organization.
