농어촌 산업 육성에 관한 법제정비방안 연구

이 논문은 농어촌과 관련된 법령을 체계화하고 문제점을 지적하며, 법제정비방안을 제시함을 연구의 목적으로 한다. 경제행정법으로서의 농어촌 관련 법률, 즉 농어촌을 대상으로 하는 행정활동의 근거가 되는 법률의 건수는 100건이 넘는다. 시행령과 시행규칙을 합한다면 물론 그 건수는 300건을 넘어서게 된다. 이 논문은 이들 법률을 기본법, 농어촌 산업 행정법, 농어촌 지역 행정법, 농어촌 복지 행정법, 농어촌 행정조직법, 농어촌 재정행정법 등으로 그 체계화하고자 시도하였다. 위와 같은 분석 결과 법률만을 가지고는 지원과 규제의 대상이 되는 국민뿐만 아니라 법률을 집행하는 행정기관 스스로도 그 내용을 체계적으로 알기 어려울 정도로 복잡한 분야가 되었음을 찾아낼 수 있었다. 위와 같은 문제인식을 기초로 이 논문은 법령체계 재정비의 필요성을 지적하였다. 법령체계의 재구성에 있어 고려될 필요가 있는 사항으로 ①계획체계의 종합적 정비, ②행정기구의 종합적 정비, ③예측, 조사, 연구 및 평가 기능의 보강, ④산업 관련 행정수단의 체계적 정리, ⑤산업에 대한 규제수단의 체계적 정리, ⑥농산어촌 및 농림수산업 종사자에 대한 복지 수단의 체계적 정리 등을 제시하였고, 종합적으로 “농어촌 산업육성법”의 제정의 필요성과 그 구체적인 내용을 정리하였다.
Abstract
The Purpose of this paper is to show various problems the korean legal system concerning farmers and fisheries has, to systematize the laws and regulations in this area and to present concrete measures for legislative solution thereof. The number of the korean acts concerning farmers and fisheries, which is one of the part of laws on economic administration is more than one hundred, including the presidential and governmental regulations more than three hundred. These can be systemized framework acts, laws concerning productions, industries, villages, social welfares, administrative organizations and finances. Because the laws in this area are so complicated, not only the people but also the public servants who are to enforce these are enable to easily find out the appropriate rules. The necessity and some solutions of readjustment of the legal system in this area are pointed out according to the results of the analysis based on this paper. The Legislation of “the Act of the Promotion of the Farmers, Fisheries and Their Industries” is suggested and its concrete contents are presented.
