Abstract

This article examines trace of regulations regarding one of the four basic principles under International Humanitarian, principle of discrimination between combatants and civilians. This article also reviews the Interpretive Guidance on the Notion of Direct Participation in Hostilities Under International Humanitarian Law focusing on the definite goal of International Humanitarian law, fulfillment of protection of civilians. ICRC 2009 Interpretive guidance on the notion of direct participation in hostilities addressed the important but unsolved three questions among others. i) who qualify as a civilian in the context of direct participation? ii) What conduct amounts to direct participation? iii) When is a civilian directly participating such that he or she is subject to attack? Distinguishing from indirect participation, direct participation is hostile criteria on a planning of attack, authorizing and acting on the purpose during armed conflict. Conceptually, direct participation in hostile situation stresses on the outcome of cumulative affect of a certain act which has mode of direct participation. ICRC Interpretive Guidance suggest three constitutive elements of direct participation. first, the act must be likely to adversely affect the military operations or military capacity of a party to an armed conflict or alternatively, to inflict death, injury, or destruction on persons or objects protected against direct attack (threshold of harm), and second There must be a direct causal link between the act and the harm likely to result either from that act, or from a coordinated military operation of which that act constitutes an integral part(direct causation), and the act must be specifically designated to directly cause the required threshold of harm in support of a party to the conflict and to the detriment of another(belligerent nexus). Measures preparatory to the execution of a specific act of direct participation in hostilities, as well as the deployment to and the return from the location of its execution, constitutes an integral part of that act.
