Abstract

In traditional warfare, the distinction between combatants and non-combatants was relatively clear. This clarity stemmed from the spatial and temporal separation of the frontline and battlefield from civilian domains. Also, there was a clear difference in the involvement of combatants who engaged in combat on the battle field versus non-combatants who did not. However, in modern warfare, this distinction has become increasingly ambiguous, and it is expected to become even more so in the future warfare. Non-combatants have become relatively easier to intervene in modern warfare, and in some cases, they exert greater influence than combatants. Some just war theorists, known as traditionalists, have advocated for a ‘threat-based account’ to distinguish between combatants and non-combatants. However, this paper argues that the threat-based account fails to provide adequate explanation for the status of non-combatants in light of the complexities of the contemporary or future warfare. Instead, this paper contends that we should take ‘liability-based explanations’ to clarify the status of non-combatants in warfare. If the arguments presented in this paper hold merit, it implies the need for changes in international law and related institutions, as well as revisions to the criteria of the just war theory.
