Abstract
It seems awkward to discuss the constitution in the level of international society. As UN Charter Art. 2 Sec. 2 declares the principle of sovereign equality, it is reasonable to postulate that there is no constitution to provide fundamental right and government organs and to ensure the supremacy of the constitution in international level. Furthermore considering the norm of constitution, ‘fundamental law about the organization and structure of a state’, every state has apparently a constitution. After all, it is difficult to postulate that there is constitutions in global level. But it is becoming an international issue whether there is an constitution in international level due to the advent of the brand-new entity. Of course the entity is the European Union. European Union actually developed the principle of supremacy of European Union law as well as insists that the EU law takes precedence over the domestic legal norms in the level of Member States including the Constitutions regardless of their enactment time. However with help of the norm of Constitution, we are able to be possessed of the persuasive argument regarding the nature of legal norms, identity of EU and integration direction etc. In particular, we are required to analyse whether there is people to obtain the constituent power and European Union has the principle of democracy, rule of law and separation of power and so one concerning with the norm of constitution. It is possible to argue that there is a Constitution in the level of European Union in a sense that there is a concept of European Citizenship and the principle of democracy and rule of law in the European Union. In addition it is well accepted that most of Member States voluntarily comply with the legal instruments of EU based on the principle of supremacy of EU Law even though there are still recalcitrant states such as Germany and Italy etc. Nevertheless as the European Citizenship dose not the replace the nationality of Member States and there is no people or demos belonging to European Union exclusively, it is inevitable to conclude that European Union has not the principle of democracy and rule of law as a State does. Therefore, European Union can be considered as the sui generis entity in the course of the federal states. As the integration of EU go on smoothly and the cohesion of integration is enhanced in the future, European Union will be able to be possessed of the Constitution of its own.
