유럽연합 수준의 권력분립원리- ‘권력’ 개념을 중심으로 -

초록

권력분립원칙은 대의제 국가에서 다양한 국가작용으로 나타나는 국가적 과제를 그 성질과 그리고 그 기능에 따라 여러 국가기관에 분산시킴으로써 기관 상호 간의 ‘견제와 균형’을 통하여 국민의 자유와 권리를 보호하려는 국가기관의 구성 원리를 의미한다. 당해 권력분립원칙의 분석대상은 국가권력임은 물론이다. 하지만 국제적 그리고 국내적인 수준에서의 다양한 상황의 급격한 등장과 변경은 그와 같은 논의에 대한 근본적인 의문점을 던져 주고 있다. 국내 환경의 경우, 21세기가 도래함에 따른 정보화 시대의 등장과 더불어 등장한 인터넷 시대는 국내 최고법인 헌법에 있어서의 작동원리의 변혁을 직접적으로 요구하고 있어서 기존 권력분립원리에 대한 근본적인 한계를 노정시키고 있다. 뿐만 아니라 국제적인 수준에서의 유럽연합의 등장은 기존 권력분립 원리에 대한 근본적인 논의 범위의 확장을 요구하고 있기도 하다. 특히 유럽연합 수준의 권력분립원리에 대한 연구가 많지만 이는 물론 연합이 권력을 보유하고 있다는 가정 하에 이루어지는 연구들이다. 하지만 유럽연합이 국가라고 볼 수 없다는 사실을 감안한다면 국가권력을 주된 대상으로 하는 권력분립원리를 유럽연합에 대하여 직접 적용하는 분석이 설득력 있는 분석이라고는 할 수 없을 것이다. 따라서 본 논문에서는 권력의 속성(강제력, 위임, 정당성(legitimacy), 법규범의 문제)을 중심으로 유럽연합이 권력을 보유하고 있는 지에 대하여 고찰하였고 당해 연구를 기반으로 유럽연합만의 권력분립원리의 특성을 분석하였다. 특히 유럽연합의 경우에는 회원국 간 관계와 기관 간 관계를 중심으로 권력분립원리를 분석할 수 있을 것인데 전자는 수직적 권력분립의 내용으로 후자는 수평적 권력분립원리의 내용으로 분석을 수행할 수 있을 것이다. 뿐만 아니라 이를 통하여 권력분립원리의 적용 대상으로는 국가만을 설정할 수만은 없으며 다양하게 등장하고 있는 권력보유실체에 대한 대응 논리의 확보 필요성에 대하여서도 절감할 수 있을 것이다.

Abstract

Separation of powers is a political doctrine urging three separate branches of government to prevent the abuse of power abd to check each other in the scope of Constitution. Thus each of the three branches are required to be possessed of the power to check the powers of the other branches, according to the principle of separation of power. In other words this separation of power is essential to ensure the constitutional value, fundamental rights by a system of checks and balances. By the way, it is well accepted that the ‘power’ in relation to the principle of the separation of power is the ‘State Power.’However, due to the rapid changes of international and domestic circumstances, it is questionable that the principle of separation of power is to be concerned with only the ‘State Power.’ For example, when it comes to domestic circumstances, the advent of information-oriented society raise a question the discussion focusing on the state power. Furthermore considering the status of European Union, we are acquired to enlarge the scope of discussion in relation to the principle of separation of power. In particular, there are plenty of studies regarding the principle of separation of power in the level of European Union. However those studies is based on the fact that the Union is possessed of the ‘Power.’ Nonetheless, taking the fact into the consideration that the European Union is not the State, it is not persuasive to apply the argument dealing with the principle of separation of power focusing on the State to the European Union. Thus this article studies whether European Union is possessed of the power considering the nature of power with the tool of the analysis such as the enforcement, entrust, legitimacy and legal norms etc. Afterwards, this article inquires in the specific character of the principle of separation of power in the level of EU based on the premise that European Union obtains the power of its own. In particular, in the event of European Union, we are able to the principle of separation of power placing emphasis on the relation with the Member States and inter-institutional relations. The Former is to be called vertical separation of power and the latter is to be called the horizontal separation of power. Furthermore, this study ensures that we can not able to limit the State Power in relation to the principle of separation of power, we need to develop the response logic to the various emerging entity possessing the power.
