Abstract

Globalization in business transactions has made traditional territorial borders almost break down. While intellectual property rights are still national rights, territoriality of intellectual property rights must now face the reality of the erosion of national borders. Differing national intellectual property laws raise difficult situation to make a unified system for intellectual property rights. But it is not always appropriate to rule on such matters with a unified legal system. Therefore, the growing number and range of international IP claims being brought to national courts highlights a need for extraterritorial approach. During the last half century, the U.S. courts affirmed extraterritorial application to international intellectual property disputes. And over the years, they have experienced an expanding range of claims involving those disputes and applied different variations of this approach. However, the U.S. IP laws are not perfect rules for all IP rights. Moreover, extraterritorial application of foreign IP laws in domestic cases could result in improper legal restraint to the sovereignty of the country in which the relevant activity took place. The current international IP framework, while it is not perfect, is improving and is the only effective and appropriate way to forward the underlying policies of intellectual property law in each country and in the world. For these reasons, the extraterritorial application of domestic IP laws requires much prudence. As Korean Antitrust Law and Capital Market Law also have rules on extraterritorial application, the extraterritorial approach is now at issue in both Korean courts and academia. In these circumstances, this study presents a comprehensive analysis of U.S. cases on extraterritorial application of U.S. IP laws and affords solutions for issues tackling it. Ultimately, this study predicts the possibilities and limits of extraterritorial application of Korean intellectual property laws to international intellectual property disputes and aims for more consistent and transparent rules of decision in this area.
