Abstract
Where acts of infringement have occurred entirely abroad, the courts have uniformly held that the presumption against the extra- territorial application of United States law bars jurisdiction. The extraterritorial application of United States law is not a matter to be taken lightly. The presumption against extraterritoriality is over- come only where: 1) there is an adverse effect on American commerce; 2) Congress clearly indicates its intent that the law should be applied extraterritorially; or 3) where the conduct takes place in the United States but the effects are felt extraterritorially. Historically, there are few areas of law where the courts, absent a clear indication that it is the intent of Congress, will take it upon themselves to overcome the presumption based upon the effects doctrine. Antitrust and trademark laws are two such areas.
