미국 동물법 발전현황과 시사점 - 미국 개물림법(Dog Bite Law)을 중심으로 -

초록

한국은 동물보호법에서 맹견의 종류를 정의하고, 2019년 3월 21일부터 발효되는 동물보호법 시행규칙에서 맹견으로 정의된 개들은 외출할 때 목줄 등 안전조치를 취해야 하고 사람을 공격해 상해를 입힐 수 있는 3개월 이상의 맹견은 입마개도 채우도록 규정하고 있다. 현재 개물림으로 상해를 입거나 사망에 이르게 되더라도 개물림을 한 개의 주인은 형법상 과실치상 또는 과실치사에 해당되어 상대적으로 가벼운 처벌을 받게 될 뿐이다. 정부를 중심으로 맹견 지정 대상 확대와 상해, 사망사고 시 개물림을 한 개의 소유주에 대한 처벌 강화가 추진되고 있지만 동물보호단체들을 중심으로 한 반대여론에 밀려 진전되지 못하고 있다. 미국 모든 주에는 개물림 사고 예방, 처리와 관련해서 주와 카운티, 시 등에서 행정법적으로 통제하는 ‘위험한 개 법(dangerous dog law)’과 ‘특정 종 통제법 (Breed-Specific legislation)’이 있다. 그리고 개물림 사고가 발생했을 때 개물림을 한 개의 주인에게는 불법행위법상의 손해배상책임이 부과되는데, 손해배상은 세 가지 법리, ‘원 바이트 법칙(one bite rule)’, ‘혼합 개물림 책임법 (Mixed dog bite law)’, ‘개물림 엄격책임법(dog bite strict liability law)’,에 따라 결정된다. 현재 캘리포니아주를 비롯한 30개 주가 ‘개물림 엄격책임법 (dog bite strict liability law)’에 따라 개물림을 한 개의 주인에게 엄격한 손해배상책임을 부과한다. 본 소고는 미국 개물림법의 종류와 현황에 대해 살펴보고, 현재 농림축산식품부를 중심으로 맹견지정 대상 확대와 상해, 사망사고 시 견주처벌 확대 방안 등을 추진하지만 법 개정에 어려움을 겪고 있는 한국에 대한 시사점을 제시한다.

Abstract

The Republic of Korea(ROK) defines the kinds of Vicious Dog(VA) in the Animal Protection Act(APA), and the Enforcement Rules of the APA effective as of March 21, 2019 provides that the dogs classified as the kinds of VA must take precautions like leash when going out of the owner’s property, and a VA over 3 month’s old, which can attack a person to harm, must have a muzzle(gag). Now, though a person is harmed by a dog attack, even come to death, an owner of the dog that attacked is under relatively less severe punishments like negligent homicide(manslaughter) or criminal negligence. Almost all states of the USA have dangerous dog law and breed-Specific legislation that are administrative laws of a state, county and city for the purpose of the prevention and handling of dog attack incidents. And, when dog attack incidents happened, the owner of a dog that attacked should take responsibility for the harm caused by the dog attack to the victim under the compensation theory in the Torts law. The compensation under the Torts law in the case of dog attack may be decided by one of the 3 theories: one bite rule, Mixed dog bite law, and dog bite strict liability law. This article reviews the dog attack laws of the US and provide several suggestions to the Korean government that is in great stress to expand the kinds of VA and heighten punishments to the dog owner in the case of dog attack case.
