성범죄 규정의 정비방안

본 연구에서는 여러 법률에 산재하는 성범죄 규정을 행위 유형에 따라 분류한 뒤, 형법전을 중심으로 통일시키는 방안을 제시하였다. 주요한 내용은 다음과 같다. ① 「성폭력범죄의 처벌 등에 관한 특례법」 제5조에서 제7조까지의 규정과 「아동・청소년의 성 보호에 관한 법률」 제7조를 「형법」에 편입시켜 규정체계의 통일성 및 명확성을 높일 필요가 있다. ② 「성폭력범죄의 처벌 등에 관한 특례법」 제10조의 업무상 위력 등에 의한 추행죄는 「형법」 제303조에 함께 규정하는 것이 합리적이다. ③ 「성폭력범죄의 처벌 등에 관한 특례법」 제8조와 제9조, 「아동・청소년의 성 보호에 관한 법률」 제9조와 제10조를 「형법」제301조와 제301조의2에 편입시키고 법정형을 조정하는 작업이 필요하다. ④ 「성폭력범죄의 처벌 등에 관한 특례법」 제13조와 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제74조의 벌칙은 「형법」 제22장의 편입하는 것이 타당하다. ⑤ 「아동복지법」 제71조 제1항 1의2의 규제 대상을 「아동・청소년의 성 보호에 관한 법률」 제15조의2 제2항에 해당하는 행위 이외의 행위로 제한하고, 그 법정형도 「아동・청소년의 성 보호에 관한 법률」 제15조의2 제2항보다 낮출 필요가 있다. ⑥ 「장애인복지법」 제86조 제1항의 구성요건을 더 명확하게 규정하고, 법정형 중 벌금형의 상한을 낮출 필요가 있다.
Abstract
In this study, after classifying the sex crime regulations scattered in various laws according to the type of behavior, a plan was proposed to unify them around the criminal code. The main contents are as follows. ① It is necessary to enhance the unity and clarity of the regulatory system by incorporating Articles 5 through 7 of the Act on Special Cases Concerning the Punishment, etc of Sexual Crimes and Article 7 of the Act on the Protection of Children and Juveniles Against Sexual Abuse into the Criminal Act. ② It is reasonable to stipulate in Article 303 of the Criminal Act together with Article 10(Indecent Acts through Abuse of Occupational Authority) of the Act on Special Cases Concerning the Punishment, etc of Sexual Crimes. ③ It is necessary to incorporate Articles 8 and 9 of the Act on Special Cases Concerning The Punishment, etc of Sexual Crimes, and Articles 9 and 10 of the Act on the Protection of Children and Juveniles Against Sexual Abuse into Articles 301 and 301-2 of the Criminal Act and adjust the statutory punishment. ④ Article 13 of the Act on Special Cases Concerning The Punishment, etc of Sexual Crimes and Article 74 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. make sense to incorporate Chapter 22 of the Criminal Act. ⑤ The subject of regulation under Article 71 (1) 1-2 of the Child Welfare Act is limited to acts other than those falling under Article 15-2 (2) of the Act on the Protection of Children and Juveniles Against Sexual Abuse, and the statutory sentence needs to be lower than Article 15-2 (2) of the Act on the Protection of Children and Juveniles Against Sexual Abuse. ⑥ It is necessary to more clearly define the Article 86 (1) of the Act on Welfare of Persons with Disabilities and lower the upper limit of fines.
