Abstract

Since adopting Convention on Cybercrime by Council of Europe at 8th 2001, many countries have been made efforts to prepare for match their statues against cybercrime the level required by Convention on Cybercrime, which is estimated as Global standard. Therefore, our country must take a positive action for legislation for joinning and ratification the treaty to cope effectively with Cybercrime. In Japan, there is already legislative action that is prepared for Convention on Cybercrime, and new bill is presented to diet at 2004. We should take new legislation against Convention on Cybercrime, compared with Japan. Japan has criminal law system similar to Korea, so discussion about reform bill in Japan is helpful to our legislation. I think as measures of criminal law for Convention on Cybercrime it is necessary to reform the statues of Act on Promotion of Information and Communication Network Utilization and information Protection, etc.
