일본의 사이버위기 관련법제의 현황과 전망

Abstract

The Japanese Government try to prevent in advance the issues, the expansion of the damages occurred and to review the cases with laws, various disciplines and guidelines. Of course, it is not easy perfectly to prevent in advance cyber-terrorism due to the characteristics of cyber-terrorism which transcends time and space and is not seen the signs. But the Japan has the systems that both government and private sector information security are an important parts of national information security as to respond it effectively. The fatal accident did not happened yet, to prepare the very serious terrorist attacks expected, they seem to review the national emergency laws precisely. In other words, since the 2004, some politicians insist the enactment of the law ‘Emergency Act(tentative title)’ which roles as a fundamental law of ‘Act of Armed Attack’ and ‘Nation Protection Act’. But, the act has not been legislated, because of the strong opposite opinions being raised, which is not require it for consistency with the Act of Disaster Protection and Nation Protection Act. In addition, ultimately, they can consider to respond the crisis on the information network, namely the upcoming cyber-terrorism, with the combination of information security laws. Also, the Japan endeavor to breed the human resources which can manage the hardware for information and information network, have knowledge of technical safety devices and hardware systems, and can combine between the businesses and the business-administration, and enforce the user's awareness of security.
