데리다의 환대의 윤리에 대한 법철학적 성찰

현대사회의 복잡성, 중층성, 그리고 다원성은 모더니티 기획에 대한 재검토와 근대법과 철학에 대한 새로운 성찰의 필요성을 요청한다. 특히 오늘날 현전(現前)으로 다가와 있는 이방인의 문제, 곧 이질성 및 혼종성을 법체계에서 수용하기 위한 도전적 과제를 해결하는 데 있어서 법은 근본적인 한계에 직면해 있다. 주체와 타자, 그리고 동일자와 차이 사이에 평화롭고 조화로운 공존을 모색하고자 하는 시도는 근대법과 근대적 관용에 내재한 본질적인 한계를 들추어낸다. 이때 데리다의 환대 윤리는 법이 다양한 정의의 가치를 수용할 수 있도록 새로운 성찰의 기회를 제공해준다. 환대는 정의롭고 조화로운 사회를 지향하는 규범으로서 법이 추구해야 할 핵심 가치이자, 법적 정의와 정당성을 위한 중요한 사상적 기초가 될 수 있다. 본 논문은 법에서 포스트모던적 사유가 갖는 이론적·실천적 의의를 데리다의 환대 윤리를 통해 고찰하면서 현대 법철학에서의 성찰점을 제시하고자 한다. 이를 위해 먼저 근대적 관용과 칸트적 환대 개념의 한계를 검토하고, 이를 극복하기 위한 대안적 개념으로서 데리다가 제시하고 있는 환대의 개념과 구조를 분석한다(Ⅱ). 또한 무조건적 환대와 조건적 환대라는 아포리아와의 연관성 속에서 ‘도래할 정의’와 ‘환대의 법’을 논하고, 환대의 실천으로서 법의 나선형적 생성에 대해 살펴본다(Ⅲ). 나아가 환대의 윤리가 법에서 주체와 타자의 관계를 재구성하며, ‘변화 가능한 보편성’을 통해 역동적으로 살아있는 법이 되도록 한다는 점에 집중하여 그 법철학적 함의를 정리해본다(Ⅳ). 마지막으로 이질성과 혼종성의 시대에서 법이 정의를 실현하는 규범이 되기 위해서는 고유성과 다양성을 존중해야 하며, 이를 위한 법철학적 성찰의 기초로서 데리다의 환대의 윤리가 갖는 의의와 한계를 정리하면서 논의를 맺고자 한다(Ⅴ).
Abstract
The complexity, multilayeredness, and plurality of contemporary society call for a review of modernity and new reflection on modern law and philosophy. In particular, the law faces fundamental limitations in addressing the challenges of the strangers, the heterogeneity and hybridity, which are present in the legal system today. Attempts to seek peaceful and harmonious coexistence between the subject and the other, the same and the difference reveal the essential limits inherent in modern law and modern tolerance. Derrida’s hospitality ethics offers new opportunities of reflection for the law to embrace various values of justice. Hospitality is a norm that aims for a just and harmonious society, a core value for law, and an essential ideological foundation for legal justice and legitimacy. This paper attempts to present the reflections in contemporary legal philosophy by examining the theoretical and practical significance of postmodern thinking in law through hospitality ethics. To this end, the limitations of modern tolerance and Kant’s hospitality concept are examined, and the concept and structure of hospitality proposed by Derrida are analyzed as an alternative concept to overcome these limitations(II). Furthermore, we discuss ‘justice to come’ and ‘law of hospitality’ in relation to the aporia of hospitality, and examine the spiraling creation of the law as a practice of hospitality(III). Afterward, this paper defines the legal philosophical implications of hospitality ethics in that it reconstructs the relationship between the subject and the other and approves ‘universality with variability’ in the law(IV). Finally, this paper confirms that the law must respect singularity and diversity to achieve justice in the age of heterogeneity and hybridity. For this purpose, we would like to conclude by summarizing the meaning and the limitation of Derrida’s hospitality ethics as the basis of a new legal philosophical reflection(Ⅴ).
