환대의 법과 정의의 아포리아

초록

다양성 사회로의 전환을 경험하고 있는 오늘날의 현실은 법에 그 철학적 바탕에서부터 근본적인 성찰을 요청한다. 다양성의 존중은 사회적 갈등을 봉합하고 진정한 사회 통합을 이루기 위해 필수적일 뿐만 아니라, ‘다름’에 대한 태도를 재고하여 인간의 가치와 사회정의에 대해 성찰하게 함으로써 정의로운 시민공동체로 나아가는 데 중요한 역할을 하는 지향점이라 할 수 있다. 그러나 보편의 추구와 이성의 확신을 내용으로 하는 로고스중심주의에 기초한 근대성과 근대법은 이러한 사명을 수행하는 데 있어 근본적인 한계를 드러낸다. 자크 데리다의 환대론은 법에 새로운 성찰의 기초가 될 수 있다. 환대론은 전체성과 주체 중심성의 법체계가 가지는 자기모순을 해체하는 동시에 차이에 열려 있고 타자성을 지향하는 규범적 가치를 제안한다. 본 논문은 다양성의 사회 현실을 법학적으로 성찰하고 대응하기 위한 사고의 틀로서 데리다의 환대론에 주목하고, 이를 바탕으로 정의와 법의 새로운 가능성을 제안하고자 한다. 이를 위해 먼저 환대 윤리의 규범성과 그 개념 및 대상을 검토하고, 환대의 이원법적 구조에 내재하는 역설을 확인함으로써 환대의 이론적·실천적 의의를 고찰한다(Ⅱ). 또한 환대의 아포리아와의 관계 속에서 ‘환대적 정의’ 및 ‘환대의 법’을 논함으로써 정의와 법의 의미를 해체적으로 재구성하고 양자의 관계를 새롭게 모색한다(Ⅲ). 이어서 환대의 윤리가 환대적 정의와 법적 정의를 거쳐 환대의 법으로 제도화되는 과정을 살펴본 이후에(Ⅳ), 아포리아에 대한 분석을 바탕으로 환대의 법이 생성되고 해석되는 양상을 제안한다(Ⅴ). 마지막으로, 이제까지의 논의를 해체적 ‘사유’와 ‘실천’, 그리고 그 둘의 역설을 해결하고 공존하게 해 주는 ‘매개’라는 삼원적 구조로 정리하면서 논의를 맺고자 한다(Ⅵ).

Abstract

Today’s reality, which is experiencing a transition to a diverse society, calls for a fundamental reflection on the law from its philosophical basis. Respect for diversity is not only essential for sealing social conflict and achieving true social integration, but also plays an important role in advancing toward a just civic community by rethinking attitudes toward ‘difference’ and reflecting on human values ??and social justice. However, modernity and modern law based on logoscentrism, which pursues universality and is convinced of reason, reveal fundamental limitations in carrying out this mission. Jacques Derrida’s hospitality theory could be the basis for a new reflection on the law. Hospitality theory deconstructs the self-contradiction of the legal system characterized by totality and subject-centeredness and at the same time proposes a normative value that is open to differences and aspire toward the otherness. This paper focuses on Derrida’s hospitality theory as a framework of thinking to legally reflect on and respond to the social reality of diversity and, based on this, attempts to propose a new possibility of justice and law. To this end, first, the normativeness of hospitality ethics, its concept and object are reviewed, and the theoretical and practical significance of hospitality is examined by confirming the paradox inherent in the dualistic structure of hospitality(II). Also, by discussing ‘hospitality justice’ and ‘law of hospitality’ in the relationship with the aporia of hospitality, the meaning of justice and law is deconstructed and the relationship between the two is newly explored(III). Next, after examining the process of institutionalizing hospitality ethics into law of hospitality through hospitality justice and legal justice(IV), we propose a form in which the law of hospitality is created and interpreted based on the analysis of Aporia(Ⅴ). Finally, this paper would like to conclude by arranging the discussions so far into a ternary structure of deconstructive ‘thinking’ and ‘practice’, and ‘mediation’ that solves the paradox of the two and allows them to coexist (Ⅵ).
