한국의 2차 미술시장(Secondary Art Market)은 크게 화랑업계와 경매업으로 나뉘어져 있는 가운데 현재 급속히 성장한 경매업에 대한 화랑업계의 대응 수위가 매우 높아진 실정이다. 가장 큰 이유로는 경매업이 미술시장에서 또 다른 수익창출을 위한 미술 사업의 도구로 등장함에 따라 우후죽순 형태로 변화될 가능성이 보이기 때문으로 추측된다. 이에 본 논문에서는 경매업이 지니고 있는 순기능, 추정가격 결정기능과 작품가격 조정 기능 등 능동적 기능이 무엇인지를 살펴보고 공정성에 기초하여 분석해 보고자 했다. 또한, 미술시장이 지니고 있는 고유의 비공정성 속에 사회적인 약속으로서 경매업의 윤리적 기능과 역할 및 의무가 무엇인지를 분석했다. 이를 통해, 경매업의 대주주가 화랑이 되어서는 안 되는 이유, 직접 작품을 매입하여 경매에 올리는 경우 등이 타당하지 않은 이유 그리고 과다한 생존 작가 작품의 취급은 화랑업계의 고유기능 침해인 이유 등이 문제제기 되었으며, 따라서 경매업을 규제 및 관리할 수 있는 경매업 허가제, 위탁물품 관리규정, 경매장의 운용 준수규정 등 법률 환경의 조성이 시급함을 도출했다.
Abstract
Korea’s secondary art market is largely divided into the gallery field and auction field and currently, the response level of the gallery field to the rapidly growing auction field is very high. The biggest reason for such a high level of response is the looming possibility that art auction may change into uncontrollable forms as the auction business appears as a tool to create profit. In this regard, the current thesis tried to look into the positive functions of the auction business including its good functions, estimated price-deciding function, art work price-adjusting function and etc. and analyze them on the basis of fairness. Also, it analyzed the ethical functions, roles and duties of the auction business as its social promise amid the unfairness inherent to the art market. Through this, it drew out the reason that large share holders of the auction business should not be galleries, the reason that it’s not proper to put on auction works directly purchased, the reason that too many works of living artists handled in auction intrude upon the functions inherent to the gallery field and etc. In this context, it analyzed the urgent needs for forming legal environments including a permit system of the auction business that can regulate and manage auction, regulations on managing commissioned works, regulations on observing auction site management rules and etc.
