인권과 건강의 상호교차성- 보건의료의 측면에서 본 인간 존엄성과 사회적 존엄성 -

이 글은 보건의료의 측면에서, 인권과 존엄이 갖는 의미와 권리로서의 건강과의 상호교차성을 분석하고, 이들의 해석과 적용을 통해 건강권의 법적 지평을 넓히고자 하는 시도를 담고 있다. 특히, 사회적 관계로서의 존엄성 개념에 주목하였다. 인간 존엄성이 자율적인 인간으로서 자신이 직접 부여하는 스스로에 대한 존엄인 반면, 사회적 존엄성은 이러한 인간 존엄성이 특정한 사회적 상호작용에서 어떻게 실현되는지에 대한 관계에서의 존엄이다. 사회적 존엄성 개념을 통하여 인간다운 삶과 웰빙의 조건으로서 건강과 인권은 세 가지 상호교차성을 가진다. 첫째, 건강 문제를 다룬 인권 정책, 프로그램, 실천과의 연관성이다. 이들은 공중보건의 목표와 인권 규범 간의 최적 균형을 맞추기 위해 상호작용한다. 둘째, 권리의 침해로 야기되는 건강 효과이다. 인권 침해는 개인의 건강 보장과 연관하여 위해를 가져올 수 있다. 셋째, 인구집단의 건강 증진과 보호는 인권의 증진 및 보호와 불가분하게 연관된다. 따라서 건강과 인권의 상호의존성은 본질적, 개념적, 실천적으로 사회적 존엄성이라는 하나의 프레임 안에 있다. 지역사회에서 인권 프레임에 입각한 건강 증진의 실천은 이러한 존엄성에 대한 이해를 풍부하게 하면서 건강 증진 활동을 활성화 하는데 도움을 준다. 그리고 현대 사회에서 건강권의 보장 영역을 확대하는데 새로운 기회를 제공한다.

Abstract

This study reflects an attempt to analyze the significance of human rights and dignity and their intersectionality with health as a right from the perspective of health care and, by interpreting and applying them, to broaden the legal horizons of the right to health. In particular, we focused on the concept of dignity as social relations. While human dignity is dignity-of-self directly bestowed by an individual on himself or herself as an autonomous human being, social dignity is dignity-in-relations regarding how such human dignity is realized in specific social interactions. Through the concept of social dignity and as the conditions for humane life and well-being, health and human rights have three intersectionalities. First, there is their correlation with human rights policies, programs, and praxis that address health problems. They interact to reach the optimum balance between the goals of public health and human rights norms. Second, there are health effects brought about by infringements on one’s rights. Infringements on human rights can cause harm in relation to individuals’ health security. Third, the promotion and protection of populations’ health are inseparably connected to the promotion and protection of human rights. Consequently, the interdependence of health and human rights essentially, conceptually, and practically lies within the single framework of social dignity. The praxis of health promotion within communities based on the framework of human rights helps to enrich one’s understanding of such dignity and to vitalize health-promotion activities. In addition, it provides new opportunities to the expansion of the scope of the securement of the right to health in contemporary society.
