토의민주주의의 민주적 정당성에 관한 연구: 동일성의 원리를 중심으로

이 논문은 신귀족층 중심의 현대 엘리트 민주주의 비판으로부터 시작한다. 현대민주주의가 ‘선거’와 ‘다수결’이라는 대표 선출의 형식 요건에만 치중함으로써 동의원리의 극단적 한계를 드러내고 있다는 문제의식 하에서, 이 논문은 토의 민주주의원리를 통한 민주적 정당성 복원의 가능성을 찾고자 하였다. 민주적 원리와 관련하여 경계해야 할 두 가지로 철인지배와 다수결정 원리를 문제 삼고 있다. 또한 민주적 동일성 원리에 대한 의미 축소 및 동종성 원리로의 왜곡에 대해 비판적 검토를 수행하였다. 최근의 사례에서도 확인되듯이 토의 원리는 이론적 맥락을 넘어 정치적 제도화에 있어서도 민주주의의 새로운 잠재력을 보여주고 있다. 토의 민주주의의 동일성 원리는 대의제 원리의 한계에 민주적 가능성을 접목할 수 있는 가능성을 제시해주고 있다.
Abstract
From the ancient Athens to the present, we understand the concept of democracy as a compound word of Demos and Kratia. The domination of the people have been stood as a symbol for the democracy. However, we observed that its value is faced with a fixed dilemma in the political life. In order to restore democratic legitimacy, this study depends on the deliberative democracy. This work is trying to overcome the limit of the principle of representation at the same time, to restore the principle of identity. The deliberative democracy based on the ‘deliberative politics’ differs from not only the domination of elite, but also the Schumitt’s political viewpoint which is classification of friend and enemy. The deliberative democracy produces democratic potential through the deliberative model based on the mutual understanding, participation and openness.
