地方公共団体における個人情報の管理の統制： 個人情報保護条例の実態

個人情報保護法制は、個人情報の保護に関する法律，行政機関の保有する個人情報の保 護に関する法律及び独立行政法人等の保有する個人情報の保護に関する法律に加え，個人 情報保護条例を各地方公共団体が制定する。このため、各地方公共団体で異なる内容の条 例が存在しており、「個人情報保護法制2000個問題」が指摘されている。また、国と地方 公共団体の役割分担が不明確であるほか、地方公共団体には条例制定義務を有するか等の 問題もある。全国の都道府県及び市区町村の個人情報保護条例を収集し、データベース作 成を試みた結果に基づき、個人情報の定義や要配慮情報について地域による相違があるか 調査した結果についても報告する。改革のあり方を決定する必要があり、住民による民主 的統制の必要性が増大している。
Abstract
Japan’s personal information protection legislation consists of Act on the Protection of Personal Information, Act on the Protection of Personal Information Held by Administrative Organs, and Act on the Protection of Personal Information Held by Incorporated Administrative Agencies, etc. and every Local governments to enact an ordinances the protection of personal information. The regulations of each different content are present, “2000 kinds of personal information protection legislation problem” has been pointed out. Collecting personal information protection provisions of the prefectures and municipalities in Japan in order to create a database, I report the results of the investigation the differences by region for procedures such as in the case of defined of personal information or sensitive information.
