유럽평의회 사이버범죄방지협약 성과에 대한 실증적 검토

사이버범죄방지협약은 세계 60여개 국가가 가입하는 등 사이버범죄 대응의 플랫폼으로 기능하고 있다. 다만, 우리나라의 경우, 사이버범죄방지협약에 가입하지 않는 등 국제적 대응체계와는 다소 거리를 두고 있다. 이에 이 연구에서는 사이버범죄방지협약 관련 실증 연구 및 자료를 검토하여 협약의 성과를 확인하였다. 연구 결과, 사이버범죄방지협약은 사이버범죄에 대응하기 위한 국제적인 협력이라는 상징성과 더불어, 국가간 형사사법공조 및 민간과의 협력을 활용하여 활발하게 활용되고 있다. 국제적인 성격을 가지고 있는 사이버범죄의 대응을 위해서는 공통된 국제적 기준 및 상호협력이 필요하다는 점에서, 효과적인 사이버범죄 대응을 위하여 사이버범죄방지협약의 가입이 필요하며, 이를 위한 국내법상 이행 입법이 신속히 이루어져야 한다.
Abstract
The Council of Europe Convention on Cybercrime is currently being used as a platform for cybercrime countermeasures that require instant evidence-preservation. In this study, the effectiveness of the Convention was examined using the empirical studies and data related to the Convention on the Prevention of Cyber Crime, focusing on the original data of the T-CY assessment report. As a result of the research, the cybercrime convention has been actively utilized with the symbolic international cooperation to cope with cybercrime, cooperation with the international criminal justice and cooperation with the private sector. In addition, in many countries, information gathered using police cooperation has no evidence capability in the trial, but in the case of evidence obtained through MLA, evidence is recognized in the trial. In order to respond effectively to cybercrime, which has an international character, common international standards and mutual cooperation are necessary. Therefore, it is necessary to join the Cybercrime Convention for effective cybercriminal countermeasures.
