軍 테러 예방을 위한 관련 법령 및 시스템 개선 방안 -국방부 대테러 활동 훈령 개정 소요를 중심으로-

냉전 종식 이후 국가의 안보를 위협하는 테러가 전 세계적으로 증대되고 있다. 본 연구는 증가 추세를 보이는 국내·외 테러 위협이 군내에서도 동일 흐름으로 발생 중이라는 것과 그 위협의 심각성을 사례를 통해 밝힐 것이다. 또한, 본 논문은 이러한 군내 테러 위협 증가에도 불구하고 현재 존재하는 법령이 테러 예방을 위한 국방부 및 각 군의 책임과 의무이행 준수에 부족함을 지적하는 동시에 그 한계점과 문제점을 진단할 것이다. 즉 본 논문의 의의는 군내 테러사례와 예방을 위한 법적 한계점 분석을 통해 국제적 테러 증가에 보조를 맞춰 점증하고 있는 군내 테러 예방을 위한 법령 및 시스템 개선을 위한 방안의 제시에 있다.
Abstract
Since the end of the Cold War, terrorism that threatens the security of nation-states has increased worldwide. This study will reveal the fact that domestic and foreign terrorist threats, which are showing an increasing trend, are occurring in the same flow in the military and the seriousness of the threat through cases. In addition, this paper will point out that the current laws and ordinances are inadequate to comply with the responsibilities and obligations of the Ministry of National Defense and each military for the prevention of terrorism in spite of the increase in the threat of terrorism in the military, and at the same time, will diagnose the limitations and problems. In other words, the significance of this paper is to suggest measures for improving laws and systems for the prevention of terrorism in the military, which is increasing in line with the increase in international terrorism through analysis of legal limitations for prevention and cases of terrorism in the military.
