친밀한 파트너 살인의 특성에 관한 연구: 헤어진 파트너 대상 스토킹을 중심으로

A Study on the Characteristics of Intimate Partner Homicide : Focusing on stalking of victims

본 연구는 친밀한 파트너 관계에서 발생한 살인의 특성과 헤어진 파트너를 상대로살해 전 나타난 스토킹의 위험성을 탐색하여 범죄예방과 재범방지를 위한 기초자료의제공에 목적을 두었다. 이에 친밀한 파트너 살인에 대한 문헌 고찰과 국내에서 2017 년~2019년 발생한 1,333건의 살인사건 중 친밀한 파트너를 살해한 형사 1심 판결문336건을 바탕으로 친밀한 파트너 살인의 특성 중 심각한 위험 요소인 헤어진 연인에대한 스토킹을 중심으로 가해자와 피해자의 관계, 범행동기, 정신질환, 알코올 남용, 범행 발생 장소, 흉기 종류 및 살해 방법을 분석하였다. 연구결과 친밀한 파트너 살인은 전체 살인 범죄의 33.4%를 차지하였고, 헤어진 연인을 대상으로 살해 전 스토킹이있었던 범죄는 37.5%로 확인되었다. 범행 특성은, 가해자의 경우 대부분 재범이상의범죄경력이 있는 남성이 스토킹이 없었을 경우는 배우자를, 스토킹이 있었던 경우는전 연인을 가장 많이 살해한 특징을 보였다. 범행동기는 대부분 정신질환이 없는 가해자들이 음주 상태에서 성적질투로 인해 우발적으로 피해자를 살해하는 특징을 보였다. 그러나 헤어진 연인을 스토킹하다 살해한 가해자들은 비음주 상태에서 계획적으로 피해자를 살해한 경우가 많았다. 살해장소 및 살해 방법은 공동 주거지에서 피해자의 목이나 몸통을 칼로 찌르거나 목 졸라 살해하는 특징을 보였다. 이와는 달리 스토킹에서이어진 살인의 경우 피해자와 관련된 장소에서 칼과 같은 흉기로 신체 여러 부위를여러 번 찔러 살해하는 양상을 나타냈다. 이러한 분석 결과를 토대로 본 연구의 의의와 후속 연구에 대한 제안점 등을 기술하였다.

Abstract

The purpose of this study was to provide basic data for crime prevention and recidivism by exploring the characteristics of crimes in ex-partner relationships and the risk a victim faced of being stalked by their ex-partner before being killed. Based on a literature review on intimate partner homicide(IPH) and 336 first-trial rulings for criminal cases involving such murders between 2017 and 2019, the perpetrator victim relationship, motive for the crime, mental illness, alcohol abuse, place and method of murder, and type of weapon were analyzed. It was found that IPH accounted for 33.4% of all homicides, and in 37.5% of cases, the victim had been stalked by their ex-partner before being killed. The characteristics of the crime showed that most of the perpetrators killed their spouses if they did not have stalking, and their former lovers if they had stalking. Furthermore, in most of the cases, the motive was characterized as sexual jealousy, with mentally sound perpetrators killing accidentally while intoxicated. However, those who had stalked and killed their former lover had done so sober in many cases. The method and place of murder were characterized as stabbing or strangling the victim in a communal residence; in the cases involving stalking, however, the pattern observed was different parts of the body being stabbed with a knife-like weapon in a place connected to the victim. Based on these results, the significance of this study and suggestions for follow-up research have been presented.
