교제폭력 입법 추진과 관계성 범죄피해자 보호조치 강화방안 - 법 집행 현장 및 절차를 중심으로 -

가해자 접근금지 등 피해자 보호조치에 대한 법적 근거가 없는 교제폭력은 2024년에 3건의 살인사건으로까지번지며 사회적 파장을 일으켰고 입법 공백 해소를 약속하는 대통령 공약과 더불어 국회 등에서 다양한 세미나 및토론회가 개최되며 발 빠르게 대응하고 있다. 본 연구는 이러한 상황에서 입법 필요성뿐만 아니라 현재 국회에 계류중인 법안이 통과 시 경찰 실무현장에서 발생할 문제점을 살펴보고 가정폭력·아동학대·스토킹·교제폭력과 같은 관계성범죄의 피해자 보호조치 강화방안을 제시하였다. 먼저, 일회성 혹은 지속·반복성의 행위를 중심으로 진행하는 스토킹과 특례법에서 지정한 죄명에 따라 범죄를중심으로 진행하는 가정폭력·아동학대의 피해자 보호조치를 구분하고 법 집행 현장의 통일적 집행을 위해 교제폭력피해자 보호조치는 범죄 중심으로 구성될 필요가 있다. 또한, 범죄를 기준으로 보호조치를 마련하더라도 단순히 교제폭력 관련 특례법 제정 또는 법 개정에만 집중할 것이아니라 기존의 가정폭력·아동학대의 보호조치 모두를 고려하며 현장에서 통일적으로 대응할 수 있도록 관계성 범죄관련 법 전체를 정비할 필요가 있다.
Abstract
Lacking a legal basis for victim protection measures such as restraining orders against perpetrators, dating violence escalated to three murder cases in 2024, causing significant social repercussions. In response, various seminars and discussions are being swiftly organized in the National Assembly and elsewhere, alongside presidential pledges to address this legislative void. In this context, this study not only examines the necessity of legislation but also investigates potential issues that may arise in police practices if the bills currently pending in the National Assembly are passed. Furthermore, it proposes enhanced protection measures for victims of relationship-based crimes, such as domestic violence, child abuse, stalking, and dating violence. First, it is necessary to differentiate victim protection measures for stalking, which focuses on single, continuous, or repeated acts, from those for domestic violence and child abuse, which center on specific offenses designated by special acts. To ensure uniform enforcement in the field, victim protection measures for dating violence should be structured around criminal offenses. Furthermore, even if protection measures are established based on criminal offenses, it's necessary to reorganize all laws related to relationship-based crimes to enable unified responses in the field. This means not only focusing on enacting new special acts or amending existing laws concerning dating violence, but also considering all current protection measures for domestic violence and child abuse.
