Abstract

This study analyzes the seriousness of violence in intimate relationships using empirical data and legal analysis, and explores legislative directions for its regulation. Violence in dating relationships manifests in overlapping physical, psychological, economic, and sexual abuse, exposing victims to repeated and structural control. Data from the Korean Women’s Hotline show that more than half of violence against women occurs in intimate relationships, alongside frequent secondary victimization during police procedures, revealing gaps in victim protection. Because such relationships are private and informal, the current criminal law system faces inherent limits in prevention and protection, making legislative intervention urgent. The study argues that the act-centered term “dating violence” obscures the structural and relational nature of the harm. It therefore proposes the concept of “relationship violence” (gyoje pogryeok) to better reflect violence rooted in intimate relational contexts. An intimate relationship is defined as one formed and maintained for intimacy, such as a romantic relationship. Relationship violence is conceptualized as acts against a partner’s will—including surveillance, assault, threats, coercion, or property damage—that cause physical, psychological, or economic harm, or impose control that seriously disrupts daily life. The study further proposes amending the Anti-Stalking Act to include relationship violence as a form of stalking, enabling emergency, urgent, and provisional protective measures.
