Abstract

After the World War II, the international community has witnessed a number of direct regulations on individuals at the international level without any involvement of their States of nationality. Targeted sanctions imposed by UN Security Council and international criminal charges indicted by the ICC are, inter alia, obvious examples of this unique and global phenomenon of individualization. An appearance of individuals at the international system has led to a historic transformation in status of individuals from objects of international law to active subjects of international law inspired by international human rights law. Hence, when punishing individuals at the international level, punishing organs should exert maximum effort to guarantee the individual’s rights conferred by international law either explicitly or implicitly, in particular, international human rights, the principle of ‘nullum crimen sine lege and nulla poena sine lege’, as well as the rule of law. This paper has originated from a doubt whether overlapping jurisdiction between targeted sanctions by UN Security Council and criminal charges by ICC is possible, indeed desirable, as suggested by several UN reports. The main focus of this paper is to review and analyze these opinions stipulated in the UN reports and to suggest possible alternative to better enhance the rule of law at the international level. This paper compares at the outset targeted sanctions and international criminal tribunal system through a variety of lenses such as definitions, developments, legal bases and characteristics and procedural protections. In particular, the paper focuses on the UN targeted sanctions’ characteristic as criminal punishment and analyzes then whether UN targeted sanctions regime guarantees individuals procedural rights as much as the ICC guarantees to individuals under criminal charges. Afterwards, the paper explains the possibility of overlapping jurisdiction between UN targeted sanctions and ICC and discusses legal issues arising out of the overlapping jurisdiction. Based upon the analysis, the paper recommends that the UN Security Council should refer relevant situations to ICC when it comes to overlapping jurisdiction, with an aim to suggest the best way to achieve international rule of law and justice and to recover credibility of two principal international organs.
