Abstract
The National Human Rights Commission of Korea is guaranteed independence, but it exists as a consensual administrative agency within the order of separation of powers consisting of the legislative, executive, and judicial branches. The character of independent institution and administrative agency is in a contradictory relationship that cannot help but conflict or offset each other depending on the degree of independence. Since the National Human Rights Commission is an agency established in our legal system according to the direction of international human rights norms without an explicit basis in the Constitution, it seems that it does not fit well with the existing order of separation of powers. Regardless of this situation, the Judicial Court and the Constitutional Court ruled that various decisions of the National Human Rights Commission were administrative dispositions. Accordingly, the National Human Rights Commission was regarded as an administrative agency without being able to resolve the contradictory relationship between its independent institution and administrative status, and its independence was bound to be weakened. In that case, it is worth paying attention to what institutional measures the National Human Rights Commission can take to realize its essential attribute of independence, and what kind of status and authority it will have and what kind of relationships it will have with other organizations within the system of separation of powers and the rule of law as a result.
