Abstract
In the age of digital transformation, information is subject to a dilution of its domain-specific nature. Information is the property of the state and it is up to legislators to allocate it. Especially in the case of artificial intelligence that learns from works and creates new expressions, there is copyright infringement at both the input and output stages. Information is a separate area with its own legal theory, and the use of such information requires the consent of the rights holder. However, AI technology based on big data is not consistent with the system of seeking individual consent. In particular, the opacity of whether and how your information is being used makes it impossible to seek redress. Therefore, this paper was focused on the principle of transparency as a core principle of regulation to overcome this phenomenon. It is expected that the principle of due process can be realized through the principle of transparency as a means to optimize basic rights among rights in the private sphere and as a means due to the uniform nature of AI.
