Abstract

This paper analyzes tax-related issues surrounding artworks through two primary lenses: tax incentive systems and regulatory mechanisms for tax crimes. It aims to propose institutional reforms to address the unique challenges posed by artworks, which, beyond their cultural value, possess high economic value and thus become significant targets of tax policy. While the use of artworks for public interest purposes—such as donations and sponsorships—can foster the art ecosystem through tax benefits granted by the state, such systems may also be misused for tax evasion and money laundering. The review of tax incentive systems examines the current structure of tax benefits granted to both donors and recipients under Korea’s income tax, corporate tax, inheritance tax, and value-added tax frameworks. The paper identifies key limitations, including the ambiguous boundary between donations and sponsorships, the limited effectiveness of tax credits, and insufficient incentives for high-value donations. Comparative analysis with foreign cases demonstrates that the diversification of tax incentives and assurance of procedural predictability can promote increased giving. The analysis of regulatory systems for tax crimes highlights how the structural characteristics of the art market—such as subjective valuation, transaction anonymity, and lack of oversight—create vulnerabilities to tax evasion and money laundering. By examining domestic and international cases, the study categorizes the mechanisms of various types of tax crimes and evaluates the limitations of current laws such as the Punishment of Tax Offenses Act, the Proceeds of Crime Act, and the Act on Specific Financial Information. While countries like the UK and the US have enhanced AML (Anti- Money Laundering) regulations on art market participants—through real-name transaction systems and mandatory suspicious transaction reporting— Korea’s regulatory response remains insufficient. Accordingly, this paper proposes several improvements: expanding tax deduction limits to incentivize donations, reforming the reserve system for nonprofit-specific activities, easing the registration requirements for designated donation-receiving organizations, introducing presumptive intent provisions for tax offenses, expanding regulation on freeports and digital assets, and institutionalizing Know Your Customer (KYC) and Suspicious Transaction Reporting (STR) obligations for art market participants. This study aims to establish a policy foundation that enhances both the fairness of the tax system and the effectiveness of regulation in the context of art-related financial activities.
