농업부문 외국인 계절근로자정책에 관한 국가 간 비교연구 -해석적 접근법의 활용-

농업 노동력 부족은 오랜 문제로, 고령화와 청년 농가 비중 감소로 인해 인력난이 더욱 심화되고 있다. 이러한 상황에서 외국인 계절 근로자 제도는 단기적으로 농업 노동력을 보완하는 중요한 수단으로 활용되고 있다. 본 연구는 외국인 계절 근로자 제도의 시행 실태와 주요 국가들의 유사 제도를 비교하여 법적･제도적 개선 방안을 모색하고자 한다. 정책분석 방법 중 해석적 접근법을 통해 미국, 캐나다, 호주, 뉴질랜드 및 우리나라의 계절 근로자 제도를 비교 분석하고, 중앙정부와 지자체의 역할 구분, 근로 조건 강화, 송출국과의 협력 체계 구축 등의 개선 방안을 제시한다. 특히, 중앙부처와 지방자치단체 간 역할 관계, 외국인 근로자의 인권 보호와 근로 환경 개선을 위한 정책적 조치, 불법 체류에 대한 대안, 언어 지원 등이 필요하다. 외국인 계절 근로자 제도가 안정적으로 정착하여 농업 인력난을 해소하고 국제적 책임을 다할 수 있도록 제도적 기반을 마련하는 데 기여할 것이다.
Abstract
Labor shortages in agriculture have long posed significant challenges, compounded by an aging farming population and declining participation by younger generations. In response, foreign seasonal worker programs have emerged as critical mechanisms to address short-term labor deficiencies in the agricultural sector. This study aims to enhance the legal and institutional frameworks governing foreign seasonal worker programs by drawing comparative insights from their implementation in South Korea, the United States, Canada, Australia, and New Zealand. Using an interpretative policy analysis approach, the study assesses the effectiveness of existing seasonal worker policies and proposes key improvements. Recommendations include clarifying government roles, enhancing protections for foreign workers, strengthening cooperation with source countries, improving working conditions, preventing illegal residency, and providing language support services. By addressing these issues, the study aims to build a robust institutional framework for foreign seasonal worker programs, alleviating agricultural labor shortages while adhering to international labor standards.
