Abstract

The report of the WTO/panel regarding Korea’s certain SPS measures for Japanese products was circulated between WTO members in February 2018. This case is about the disputes between Japan and Korea. Japan complained to the WTO against Korea’s import bans and additional testing requirements for Japanese products after the Fukushima nuclear power plant accident in March 2011. As a result, the panel found that Korea acted inconsistently with the main articles in SPS Agreement, so Korea appealed this verdict on 9 April 2018. Japan argued that Korea violated articles 5.7, 5.6, 2.3, 7, 8 in SPS Agreement. As regards to these arguments, the panel concluded that Korea’s SPS measures are inconsistent with those articles except for article 8. At the time of filing, many international scholars in Korea anticipated this result, because they already knew that verifying Korea’s opinion based on the scientific evidence is not easy. The panel found that Korea failed to establish that there was insufficient evidence with respect to the SPS Measures except for measures adopted in 2011. However we are living in an age of information, lots of information is around us nowadays. Therefore, the panel’s approach in regards to the insufficiency of information should be changed. Members want to get particular and specific information about an unknown risk or uncertainty, not just general information. If a panel would not change its approach about this requirement, article 5.7 would be a dead provision. Two other requirements in article 5.7 could prevent the trials of members form avoiding conducting risk assessment. When a panel decides member’s appropriate level of protection, it has to respect a member country’s own decision. SPS Agreement has teo conflicting aspects : one is to promote free trade; and another is to ensure member’s own right to take SPS measures necessary for the protection of human, animal and plant life or health. The latter should not be disregarded. Lastly, the panel found that similar conditions prevail regarding radioactive contamination level between Japanese products and other countries products. Based on certain data, the panel concluded that food from anywhere in the world has the potential to be contaminated with radionuclides. Yes, food in the world has the potential to be contaminated with radionuclides but really do similar conditions prevail?
