학술적 연구대상으로서 고인골의 법적 지위에 대한 검토

인골에는 과거 사회의 생활환경과 복지수준, 당시 사람들의 건강상태를 유추할 수 있는 다양한 생물학적 지표와 그 흔적들이 남아있기 때문에 옛 사람의 뼈는 과거 집단의 생물학적 특징은 물론 생물문화적 적응 양상을 밝힐 수 있는 직접적인 연구 자료가 된다. 따라서 고인골은 생물인류학은 물론 뼈고고학, 고병리학, 매장고고학, 집단 유전학 분야 뿐 아니라 오늘날에는 안정 동위원소 분석을 비롯한 고고과학적 연구에도 널리 활용된다. 고인골을 이용한 연구는 선진국과 개발도상국 모두에서 이루어지고 있으며 특히 선진국의 경우 대학과 자연사 박물관을 중심으로 인골 수집과 연구 활동이 매우 체계적으로 진행되고 있다. 그러나 우리나라의 경우 고인골을 발굴한 기관과 실제 분석을 진행한 대학의 연구기관을 중심으로 소수의 고인골 자료만이 남아있으며 현재까지 보관된 인골은 대략 2,000개체 안팎인 것으로 추정된다. 국내의 고인골 자료 수가 다른 나라들에 비해 현저하게 적은 이유는 무엇보다 인골이 현장에서 수집되고 향후에 연구 자료로 이용되기까지의 과정이 제도적인 체계에 의해 이루어지지 않기 때문이다. 해외에서는 일반적으로 100년 이상이 지난 고인골은 대체로 국가가 정한 법령에 따라 체계적인 절차에 의해 수집하고 이후에 연구기관에서 이를 관리하도록 한다. 그러나 우리나라에서는 고고학 유적에서 발굴된 고인골이 일반 분묘의 무연고 시신과 동일한 법률, 즉 ‘장사등에 관한 법률’을 기준으로 처리되고 있으며 수습 이후에 인골에 대한 분석과 보관에 대한 사항은 제도적으로 전혀 고려되지 않고 있다. 따라서 고인골을 체계적으로 수집 및 연구하는 시스템을 확립하기 위해서는 인골을 보호하고 관리하는 법적 제도가 선행적으로 뒷받침되어야 한다. 그러한 체계를 마련함에 있어 향후 기준이 되어야 할 몇 가지 사항들을 정리해보면 다음과 같다. 첫째, 고인골이 갖는 학술적 가치를 전문연구자가 판단할 수 있는 기회를 마련하여 이에 대한 보존 및 연구가 체계적으로 이루어질 수 있도록 해야 한다. 둘째, 대학과 연구소, 박물관을 비롯한 연구기관에서 고인골을 소장하며 보관은 기본적으로 특정 사유가 발생하지 않는 한 지속적으로 이루어질 수 있도록 한다. 셋째, 우리나라의 현행 법률에서는 고인골이 ‘무연고 시신’의 범주에 속하기 때문에 연구하고 향후에 보관하는데 법률적 제약이 많다. 이 문제를 해결하기 위해 기존 법규에 100년 이상이 지난 고인골에 대한 예외 규정을 삽입할 필요가 있다. 즉 기존의 문화재 관련 혹은 「장사등에 관한 법률」에 세부 조항으로 고인골이 보존되고 연구될 수 있도록 하는 규정이 필요하다. 넷째, 고인골 이외 유해의 여타 조직이 함께 남아있는 경우도 해외의 사례에서 살펴본 것처럼, 향후 고인골에 상응하는 법적 절차가 마련되어야 하겠다.
Abstract
Human skeletal remains are a unique source of information about the genetic and physiological responses our ancestors made to the challenges posed by the natural and sociocultural environments in the past. In this context, they provide an extremely valuable adaptive perspective on the history of our species. Of course, it is important to remember that these ancient human skeletons were once living people. Accordingly, these remains are to be treated in a culturally respectful manner while at the same time being utilized for research, learning and teaching purposes where appropriate. We acquire human skeletal remains as a result of archaeological projects and at times during construction works. However, there is no legal system pertaining to making ancient skeletons available for conservation and research in Korea. In this study, we examine the legal basis with regard to scientific research on human skeletal remains in Western societies. There, are at present tens of thousands of individual sets of human skeletal remains in the natural history museums and research institutions at universities in the west. Public collections holding human remains should ensure that any activities that they undertake are lawful. In Korea, a law in relation to the research and storage of human skeletons is needed to create an ancient Korean population collection for scientific studies. Thus, we suggest that laws in relation to ancient human skeletal remains in Korea are established. To this end, firstly, all present Korean archaeological situations should initially be considered with regard to legislative processes. Next, decisions about whether or not to retain ancient human skeletons permanently in the collection will be made following full consultations with appropriate specialists, including biological anthropologists. In addition, it is necessary to maintain a publicly accessible research register which details all requests in relation to research which is carried out. Lastly, the legal policies pertaining to soft tissues, including organs, skins, and osteological materials should be devised.
