The purpose of this study is to develop legal standards in the field of Korean NTIS(national technology information system). NITS is the central resource for government-funded scientific, technical, engineering,and business related information. Korean government invest lots of resource in R&D(Research and Development). However, outcome of these investment does not spread to companies. These days patent licensing strategy is dramatically changing. Thus "Invention Capital"buys not only patent but also immature idea. After they process these idea they make strong patent portfolio. This paper aims to suggest a standard to deal with NTIS and Invention Capital. Usually university professor's research idea funded by government should be protected and developed. Using the information provide from NTIS, the public would be served by having ready access with licensing conditions to a greater amount of proprietary subject matter. Finally, it will address the need to consider issues for R&D enterprises and distribution of royalties and incentives to develop a legal frmework to deal with this problem.
