Abstract
In the meanwhile, our country's juvenile policy research trend, in the operation of juvenile justice, has paid attention only to the protection of juvenile rights mainly in relation to crimes. However, it appears that the debate over acknowledging constitutional right that juveniles deserve as human subjects, is not enough. It has to be emphasized that juveniles cannot be deprived of this constitutionally guaranteed right simply because they are not adults. At the same time, we should not ignore the fact that giving the same right to juveniles as to the adult could not be the only way to secure their human right. We cannot deny that juveniles can enjoy all the rights guaranteed by the constitution, same as the adult. The right to pursue happiness, the freedom to choose one's religion, the right for equality, as fundamental rights that could be enjoyed as humans, are given to Juveniles. It is true that the right for the human as subjects has nothing to do with age. However, depending on situations, it is the reality that we impose some exceptions on individuals who do not reach the maturity by considering only mature society members as universal. Therefore, the questions regarding when it is possible to limit juvenile constitutional rights or how much the extent of limitation can be possible, could arise, in relation to this protection for the juvenile human right.
