학생자치법정 확대를 위한 제도화 방안

학생자치법정은 법무부가 중심이 되어 2006년부터 현재까지 학교, 소년원 등을 대상으로 시범운영되고 있다. 학생자치법정은 초기 미국 청소년법정을 모델로 삼고, 한국적 상황에 도입하는 것은 상벌점제를 전제로 한 학생징계절차의 일환으로 도입하고자 하였다. 따라서 학생징계 중 경미한 사안이나 초범을 대상으로 하고, 또래 청소년으로 구성된 법정 구성원들로 하여금 교육적 처벌을 통해 과벌점자가 원만한 학교생활을 할 수 있도록 함께 문제를 해결해 가는 교육프로그램이다. 이와 같은 프로그램이 정착되는데 아직은 많은 갈등과 난제가 겹쳐 있으나, 긍정적 그리고 교육적 효과도 크다는 점에서 이 프로그램의 운영 대상 학교를 확대하고, 현재 다루고 있는 경미한 사안들을 좀 더 확대하여 선도처분 사안으로 까지 확대하는 것이 최근 논의 중에 있어 이를 제도화하는 방안이 무엇인지 다루어 보고자 하였다. 법제를 통한 제도화 방안 보다는 정책적 제도화 방안이 더 타당하다고 보며, 법제적 제도화는 학교규칙으로 제도화 하는 방안이 그리고 법교육지원법을 통해 제도화 하는 방안 순으로 우선 순위를 정하여 제안하였다.
Abstract
Students court has been operating as a pilot program to the School that the Justice Department is oriented since 2006. This were introduced to Korean based on the assumption as part of a student disciplinary procedures that is model of Teen Court in U.S.A. Students Court deals with a student of the minor disciplinary matters or to target first-time offenders, and peer students are consisted of students court members. This is allow students to have the legal knowledge and attitudes and solve the problem with each others. Even though school have still many conflicts and challenges, but a positive and educational effect is greater in terms of the program operating targeted schools to expand, so, this study want to discuss a strategies that all of middle school and high school is introduced this program and on currently dealing with minor issues in a more expanded matters and that make finally plans to institutionalize what it was to deal with. The result of this study, like this ;Policy institutionalized measures is more reasonable than legislative measures. And as to legislative measures, institutionalized the school rules is more reasonable than amending the Law-related Education support Act
