신원 관리에 있어 간성(間性, intersex)의 법적 인식에 대한 고찰

신원 관리에 있어 성별은 필수적인 개인 식별 인자로 이용되어 왔다. 성별의 결정은 주로 생물학적 요소에 따라 이루어졌다. 그러나 전형적인 이분법적 성별로 분별이 어려운 간성인 사람들을 신원 관리 법제가 어떻게 포섭할지에 대하여 세계적으로 다양한 방식이 제시되고 있다. 그동안은 간성을 의료적 개입을 통해 전형적인 이분법적 성별 중 하나로 교정을 하여야 하는 상태로 보아왔으나, 유엔을 비롯한 국제기구 및 몇몇 국가들은 간성인 사람들의 인권침해를 방지하기 위하여 간성인 당사자가 충분한 정보를 기반으로 숙고한 후 그 의사에 따라 행해진 의학적 개입이 아닌 한, 무분별한 의학적 개입 금지를 촉구하고 있다. 그러나 신원 관리의 출발점인 출생등록 시 이분법적 성별 선택의 강요는 간성인 아이와 그 부모에게 거대한 사회적 압력으로 작용하여, 불필요한 의학적 개입을 증대시킨다. 신원 관리 법제에서 간성을 어떻게 인식하는지에 따라 그들의 인권침해 정도와 결정권 보장 정도가 달라지는 것이다. 따라서 신원 관리 법제에서 간성을 어떻게 인식하는지에 대하여 해외 사례와 우리 법제를 살펴보면서, 간성인 사람들의 인권침해를 최소화할 수 있는 성별 결정 방식에 대한 논의의 토대를 마련해 보고자 한다.
Abstract
In identity management, sex is used as an indispensable personal identification factor. Sex has been mainly determined by the biological factors. However, many countries today are interested in how to classify people with sex characteristics that do not fit the male/female dichotomy. Individuals with intersex conditions have been treated with medical correction until now; international organizations such as UN and some countries are now calling for an end to indiscriminate surgical intervention, especially when it is not based on their informed consent and given with sufficient information. The legal system of the identity management such as birth registration requiring intersex infants and their parents to choose either male or female is a huge social pressure on them. And it increases unnecessary medical intervention. Therefore, by looking at overseas cases and our legislation on how to perceive intersex in identity management legislation, this paper would like to lay the groundwork for discussions on how to determine sex to minimize human rights violations for intersex.
