성전환자의 성별정정허가신청사건 등 사무처리지침 제6조는 성전환자의 성별정정요건을 규정하고 있다. 위 성별정정요건은 일본의 「性同一性障害者の性別の取扱いの特例に関する法律」과 실질적인 내용이 유사하기 때문에, 일본 특례법에서 규정하는 요건의 의미, 입법취지, 비판 및 판결례를 살펴봄으로써 우리나라 사무처리지침의 문제점 및 개선방향의 실마리를 도출해낼 수 있다. 일본 최고재판소는 특례법의 요건 중 비혼요건, 미성년자녀 없음 요건, 생식선 제거수술 요건에 대해 판단하였고, 그 중 생식선 제거수술 요건의 위헌성을 확인한 바 있다. 우리나라 대법원의 경우 미성년자녀가 있는 자의 성별변경신청에 대하여 전원합의체 판결을 통해 이를 허용하였으나, 다른 요건에 대해서 직접적으로 판단한 대법원 결정례는 존재하지 않는다. 다만 하급심 법원을 중심으로 외부 성기를 형성하는 수술을 하지 않은 자에 대한 성별변경을 허용하는 결정이 다수 이루어지고 있다. 성별정정과 관련된 사항은 국민의 기본권과 관련된 중요한 문제에 해당하며 국회의 입법사항으로, 성별정정에 관한 법률을 제정하는 것이 의회유보의 원칙과 법적안정성이라는 가치를 충족할 수 있는 궁극적인 해결책에 해당한다. 다만 국회가 입법의무를 수행하기 전까지는 예규의 개정을 통해 성전환자의 성별변경과 그를 통한 성적 자아정체성의 실현을 용이하게 할 필요가 있다. 특히 의료적 수술을 요하는 예규 제6조 제3항은 삭제해야 함이 타당하다.
Abstract
Article 6 of the Guidelines for Processing Affairs, such as the application for gender correction permission for transgenders, stipulates the gender correction requirements for transgenders. Since the gender correction requirements of Korea are similar in substance to Japan's Act on Special Cases concerning Gender Treatment of Persons with Gender Identification Disabilities, it is possible to derive clues to the problems and directions for improvement of the guidelines for handling affairs in Korea by examining the meaning, legislative purpose, criticism, and judgment of the requirements stipulated in the Japanese Special Cases Act. The Supreme Court of Japan judged the requirements of the Special Cases Act on non-marriage, no child underage, and gonad removal surgery, and confirmed the unconstitutionality of the gonad removal surgery requirements. In the case of the Supreme Court of Korea, it was allowed through a full-bench ruling on the gender change application of a person with underage children, but there is no Supreme Court decision that directly judges other requirements. However, a number of decisions are being made around lower court to allow gender change for those who have not performed surgery to form external genitals. Matters related to gender correction are important issues related to the basic rights of the people, and it is a legislative matter of the National Assembly. Enacting a law on gender correction is the ultimate solution to meet the value of the principle of reservation to the parliamentary and legal stability. Until the National Assembly fulfills its legislative obligations, it is necessary to facilitate gender change of transgenders and the realization of sexual self-identity through revision of the regulations. In particular, it is reasonable to delete Article 6, Paragraph 3 of the Regulations requiring medical surgery.
