미투 운동, 구조적 인권 침해 그리고 인권교육

본 논문의 목적은 현재 한국 사회에서 발생하고 있는 미투 운동의 근본적 원인을 살펴보고, 그 근본원인인 여성에 대한 성폭력 관행과 연관된 다양한 인권 침해 문제들을 살펴본 후, 이러한 문제들을 해결해 나아가기 위한 인권교육 방향을 제시하는 것이다. 한국사회에서 발생하고 있는 미투 운동의 근본적 원인은 여성에 대해 지속적으로 이루어져온 성폭력이라고 할 수 있다. 그리고 여성에 대한 성폭력 관행은 구조적으로 성적 욕망을 부추기는 미디어, 정치권력에서의 여성차별과 배제, 노동에서의 여성차별과 배제, 여성에게 아름다움을 강요하고 가사노동을 전담하도록 하는 문화 등과 밀접히 결합되어 있다. 한국사회에서 발생하는 여성에 대한 성폭력 관행은 명시적으로는 신체의 자유만을 위반하고 있는 듯 보이지만, 구조적으로는 정치권, 노동권, 임금, 문화생활, 그리고 교육 등에서의 평등권, 교육권의 위반을 기반으로 하고 있다. 인권교육에서 이러한 문제를 해결하기 위해서는 크게 두 가지 노력이 요구된다. 첫째, 여성 자신이 인권을 침해당하고 있다는 것을 인식하고 이에 저항하고 자신의 인권을 지키며 증진시켜 나갈 수 있는 힘을 갖도록 하는 것이다. 둘째, 여성에 대한 성폭력을 가져오는 정치, 경제, 교육, 문화, 언론 등이 얽힌 한국 사회구조를 변화시켜 나아가는 것이다. 전자가 여성의 역량화에 초점을 맞추고 있다면, 후자는 한국 사회구조 변화에 초점을 맞추고 있다. 전자에서의 인권교육대상은 주로 여성이지만, 후자에 서는 인권교육대상이 여성을 넘어 남성을 포함한 일반 대중, 여성 관련 전문직 종사자, 교육자로 확대된다.
Abstract
The purpose of this article is to investigate the causes of the practice of sexual violation against woman, and the violations of human rights that the practices of sexual violation against woman bring about, and then suggests human rights education approaches against the practice of sexual violation against woman. The main cause of ‘Me Too’ movement occurring in korean society may be the practice of sexual violation against woman that have persisted long time. The practice of sexual violation against woman is related closely with the sexual desires, distribution of power, culture and education, employment and representation structures of korean society. The practice of sexual violation against woman persisting in korean society manifestly violate the liberty of person, and is based on the violations of political rights and violations of equality in pay, cultural life,education and labour rights. In order to resist against these violations of human rights, human rights educator must make efforts in two ways. first, human rights educator must encourage for woman to know the human rights breached at herself and make her empowered to resist against the violations of human rights and protect and promote woman’s human rights. Second, Human rights educator must make efforts to change the social, political, cultural and educational structures that produce and back the sexual violations against woman. In order to do it, human rights education must be expended beyond woman toward the man, public, woman-related expert, teachers.
