인권은 인간으로서 누릴 수 있는 가장 근본적이면서도 중요한 권리이다. 현대 사회에서 인권보장이 상당 부분 진전되고 있지만, ‘성희롱’은 가장 최근에서야 조명 받게 된 영역이라고 할 수 있다. 이 문제는 전통적인 남성 지배 권력에 내재한 복잡하고 민감한 성격 때문에 명확하게 논의되기도 어려웠고 따라서 제대로 해결되기도 어려웠다. 이 글에서는 성희롱에 대한 문제의식 고양과 해결을 위해 한국과 미국에서의 관련 법률과 성희롱 사례를 소개하고 연구하였다. 지금까지 성희롱 사건의 피해자 대부분이 여성이라는 점은 함의하는 바가 크다. 또한 한국과 미국의 법과 사례 분석에서 보여 주듯이 이 사안의 본질에 대해 충분히 고려하고 있는지에 대해서도 깊은 숙고가 필요하다. 기본적으로 피해자에 대한 이해와 존경심이 지켜진다면, 대부분의 성희롱 사건은 미연에 방지될 수도 있었을 것이다. ‘성희롱’은 한 성에 대한 차별이기도 하지만, 동시에 인간의 존엄성을 침해하는 중대한 사안이기도 하다.
Abstract
Human Rights have been one of the most controversial issues to be resolved throughout the history. Among them, the most complicated issue seems to be that of sexual harassment. Because of its sensitive and complicated nature of male dominance and power concerning this issue, this has not been clearly discussed or resolved. In this article, the relevant laws and legal cases of sexual harassment especially in Korea and the US were examined with a view to raising consciousness. Sexual harassment is a critical issue, particularly for females as more frequent victims in sexual harassment cases. However, as the comparative analysis of two countries reveals, the laws and legal cases do not clearly demonstrate whether underlying problems of sexual harassment are sufficiently taken into consideration. This problem seems to stem from the fundamental lack of understanding and respect toward victims to begin with. Therefore, it is necessary to redefine sexual harassment in laws and legal cases. Discrimination-based approach would provide us more equitable solutions together with dignity-based approach.
