본 연구는 기후위기가 여성에게 미치는 구조적 불평등과 젠더 기후정의의 의미를 낸시 프레이저의 정의 이론을 중심으로 분석하고, 이에 기반한 여성의 정의로운 참여 방안을 모색하는데 목적이 있다. 기후위기는 생물학적･환경적 문제를 넘어 사회적 취약계층에게 불균등한 영향을미치는 정의의 문제이다. 특히 여성은 경제적 불평등, 정치적 배제, 돌봄노동의 과중, 젠더기반 폭력 등 교차성으로 인해 기후위기에 더욱 취약하다. 프레이저의 ‘분배적 정의’, ‘인정적정의’, ‘정치적 정의’의 틀을 통해 여성의 기후취약성과 기후정책 참여의 불균형을 분석하고, 탄소중립기본법과 재난안전법 등 현행 법률의 젠더중립적 한계를 비판적으로 검토하였다. 이를토대로 성별영향평가 제도 도입, 성인지 기후예산 수립, 성별 통계 수집의 의무화, 여성의 정책결정 참여 확대 등 젠더 기후정의를 실현하기 위한 법･정책적 개선 방안을 제시하였다. 본 연구는 기후위기 대응에서 여성의 권리와 참여를 보장하는 것이 기후정의의 핵심임을 강조하며, 포용적이고 지속가능한 기후정책 수립을 위한 법적 기반을 제공하고자 한다.
Abstract
This study aims to analyze the structural inequality and gender climate justice implications of the climate crisis for women based on Nancy Fraser’s theory of justice, and to seek ways for women’s just participation based on this. The climate crisis is a justice issue that goes beyond biological and environmental issues and has an unequal impact on socially vulnerable groups. In particular, women are more vulnerable to the climate crisis due to intersectionality such as economic inequality, political exclusion, excessive care work, and gender-based violence. Through Fraser’s framework of ‘distributive justice,’ ‘recognitive justice,’ and ‘political justice,’ we analyze women’s climate vulnerability and imbalance in climate policy participation, and critically review the gender-neutral limitations of current laws such as the Carbon Neutrality Basic Act and the Disaster and Safety Act. Based on this, I suggest legal and policy improvement measures to realize gender climate justice, such as introducing a gender impact assessment system, establishing a gender-responsive climate budget, mandating the collection of gender statistics, and expanding women’s participation in policy decision-making. This study emphasizes that ensuring women’s rights and participation in responding to the climate crisis is the core of climate justice, and aims to provide a theoretical and practical basis for establishing inclusive and sustainable policies.
