교제폭력은 전ㆍ현 연인관계 내 발생하는 단순한 다툼이 아니라 상해, 살인 등과 같은 강력범죄로 이어질 수 있는 심각한 범죄행위다. 특히 가정폭력과 같이 장기간 반복적 피해가 발생해도 신고가 지연되는등 관계의 특수성이 작용하나, 이러한 특성이 고려되지 않아 가해자들은 다소 가볍게 처벌되고, 피해자들은 협박 및 보복 위험에 노출된다. 그 결과, 신체적 상해, 심리적 트라우마, 사회적 고립뿐만 아니라 자살, 살해로 이어지나 피해자들을 선제적으로 보호할 법적 근거가 부재한 상황이다. 이러한 교제폭력에는 가정폭력처럼 친밀한 관계라는 관계의 특수성으로 인한 범행의 상습성, 높은 재범률과 폭력의 진화성 등의 특성이 내재되어 있음을 고려해야 한다. 따라서 본 논문에서는 교제폭력을 「가정폭력처벌법」에 포섭시켜 시급히 피해자들을 보호하기 위한 법제화의 필요성을 논의하면서 효과적인 예방 및 대응 방안에 대한 법률안과 방향성을 제시하고자 한다.
Abstract
Dating violence or Intimate Partner Violence is not a simple dispute occurring between current or former romantic partners, but a serious criminal act that can lead to severe offenses such as assault and murder. Similar to domestic violence, the unique nature of these relationships often results in prolonged and repetitive victimization, delayed reporting, and consequently, perpetrators receiving relatively light punishments while victims remain exposed to threats and retaliation. As a result, victims suffer from physical injuries, psychological trauma, social isolation, and in extreme cases, suicide or homicide. Despite these severe outcomes, there is currently a lack of legal grounds to proactively protect these victims. Given the habitual nature of offenses, high recidivism rates, and escalation of violence inherent in intimate relationships, dating violence shares characteristics with domestic violence. Therefore, current paper discusses the urgent need to include dating violence under the "Domestic Violence Punishment Act" to provide timely protection for victims. Additionally, it proposes legislative measures and directions for effective prevention and response strategies.
