Abstract

This paper aims to structurally analyze the impact of "labor-saving technology" resulting from industrial automation and digital transformation on the employment of female workers. We particularly focus on how technological change threatens female jobs and deepens employment inequality, especially given the recent ILO report indicating that female workers are highly concentrated in clerical occupations, which are at high risk of exposure to Generative AI (GenAI). To demonstrate that this labor-saving phenomenon is not merely a current issue, the study first analyzes the impact of the introduction of PCs and automation technologies in the 1990s on female-centric jobs in sectors like banking and apparel manufacturing. We conduct an in-depth review of the structural changes where the computerization of tasks led to a decline in female employment and an increase in non-regular employment status. Subsequently, we critically examine the Equal Employment Opportunity and Work-Family Balance Assistance Act, which was enacted to address the situation at the time. We analyze the background of the introduction of the 'indirect discrimination' concept within this law and assess the practical role and limitations this legal principle had in protecting female workers' conditions and jobs against the labor-saving phenomenon. Finally, we diagnose the accelerating pace of the labor-saving phenomenon in the current service and sales sector (e.g., self-checkout counters in large marts). By examining overseas legislative responses (e.g., bills introduced in California and Massachusetts, USA) to counteract this situation, this paper seeks to contribute to the discussion on necessary legal and institutional measures in South Korea to protect female workers' employment in the future.
