Abstract

The current 「Act on Funeral Services」 in South Korea is deficient, as it fails to clearly define the system for designating a funeral director and consequently hindering the reflection of the deceased’s pre-mortem wishes. Despite profound social changes, including increased single-person households and the proliferation of non-relative caregiving, the national funeral system remains rigidly confined to an outdated, kin-centric customary framework. A major institutional obstacle is that both 「Medical Service Act」 and 「Act on Registration of Family Relations」 grant authority for death certificates, post-mortem examination reports, and death registration exclusively to next-of-kin. This structure critically prevents a non-relative designated by the deceased from carrying out the funeral, leading to significant complications such as the unnecessary processing of unclaimed bodies, prolonged storage of remains, and increased social costs, ultimately failing to ensure a dignified end of life. In sharp contrast, countries like the United States and Japan prioritize the deceased's explicit instructions, granting designated funeral directors substantive authority, such as the right to receive a death certificate, thereby securing both the deceased's rights and procedural efficiency. Therefore, This article suggested that South Korea amend the Act on Funeral Services to (1) clearly define the role of the funeral director; (2) prioritize the individual designated by the deceased; and (3) explicitly grant this designated person the authority to receive death certificates and post-mortem examination reports. This legislative revision is essential to fully guarantee the deceased's fundamental right to self-determination regarding final disposition. As the final rite respecting the deceased's personality rights, the protection of this right is a contemporary imperative and a national duty, serving as an essential extension of the constitutional rights to human dignity and worth.
