정신질환 범죄와 경찰의 대응에 관한 연구

오늘날 정신질환자의 증가는 필연적으로 정신질환 범죄발생 빈도의 상승을 예측케 한다. 정신질환 범죄는 동기가 명확하지 않고 피해자가 무차별적이라는 측면에서 일반범죄보다 심각성이 크고 국민불안을가중시킨다. 정신질환자는 적정한 치료를 받을 권리가 있으며 국가와 자치단체는 정신질환자의 치료를위하여 노력하여야 한다. 그러나 정신질환자가 적정한 치료를 받지 못하고 방치되면 언제든지 범죄를 실행할 수 있다. 정신질환 범죄로부터 국민의 안전을 확보하기 위해서는 정신질환 범죄신고를 처리하는 경찰의 역할이 중요하다. 그러나 정신질환 범죄에 효율적인 대응을 위해서는 경찰의 노력만으로 한계가 있다. 본 연구에서는 정신질환 범죄 현황 및 경찰의 대응실태를 분석하고 개선방안을 고찰하였다. 첫째, 정신질환 범죄에 대한 인식 개선을 위한 교육프로그램을 마련하여야 한다. 또한 효과적인 대응을위해서는 경찰서 형사과에 전문대응팀을 신설하는 것을 검토하여야 한다. 둘째, 정신질환자 정보를 공유할 수 있는 시스템을 마련하여야 한다. 정신건강복지법의 개정이나 경찰관직무집행법의 사실조회 규정을 근거로 중증 정신질환자 퇴원 정보를 확보하여 관리할 수 있어야 한다. 셋째, 정신질환자의 치료 및 범죄예방을 위하여 행정입원 및 응급입원을 적극적으로 활용하여야 한다. 이와 병행하여 정신의료시설을 확충하여야 할 것이다. 넷째, 경찰은 정신질환 범죄사건의 처리기준과 매뉴얼을 만들어 절차의 명확성 및 객관성을 확보하여야한다. 경찰은 정신질환 범죄사건 처리의 게이트 키퍼 역할을 한다. 경찰의 처리기준이 명확하고 객관적일때 정신질환 범죄를 예방할 수 있다. 마지막으로 경찰, 자치단체, 정신의료기관 간의 협력체계를 구축하여 정신질환 범죄의 예방에 공동 대응하여야 한다. 자치단체, 정신의료 기관의 적극적인 협력 없이 경찰의 독자적인 정신질환 범죄 대응은 성공할 수 없다.
Abstract
A mental disorder, also called a mental illness, is a behavioral or mental pattern that causes significant distress or impairment of personal functioning. In Korea, the number of people with mental disorder and mental disorder crimes are increasing steadily due to stress and other reasons. The police are very often the first to be called to deal with persons with mental disorder crimes. In this article, I examine how police respond to the mental disorder crime cases called by 112 and suggest improvement measures. First, police agency have to prepare training program in recognizing mental illness and knowing how to deal with mental disorder crimes. Also, Specialized Team like Crisis Intervention Team in U.S should be organized to deal with mental illness crimes effectively. Second, it is necessary to make system to share the mental disorder information between police and mental service provider by law. Third, mental disorder offenders should be hospitalized actively to prevent recommitting crimes. Fourth, collaboration between police department and local government including mental health system is crucial to deal with mental disorder crimes effectively. Lastly, Police Agency should define guideline and manual regarding how to handle crimes related to mental illness in detail.
