Abstract
Platform work is mentioned as a key form of labor in the era of the Fourth Industrial Revolution. The increase of platform work can provide an opportunity to create new jobs and ensure flexibility in labor providing the convenience of immediate response to consumer needs. However, in many cases, platform workers are deprived of guarantees of working hours, minimum wage, annual leave, employment insurance, and various allowances, and there is a possibility of proliferation of long-term and low-wage labor conditions. Currently, many countries including Korea have been engaged in a lot of disputes over their legal status as platform workers are rapidly increasing. Many platform workers in Korea make a consignment contract with platform business as the self-employed, and they don’t have employee status. Therefore platform workers are not properly protected by labor-related laws such as Labor Standards Act, Trade Union and Labor Relations Adjustment Act and are exposed to unstable status. In particular, health and safety problems caused by the poor working environment of platform workers, problems of economic poverty, and bogus freelancer practices using the unstable status of platform workers remain unsolved. It is essential to come up with measures for legal protection to platform workers as those problems can have a significant impact on the overall society and economy, including the labor market, as well as on the stability of individual lives of workers. In this paper, we try to find the alternatives for improving the legal status of platform workers through comparative legal studies of relevant legislation, practices and trends in the United States, Belgium, the United Kingdom, France and the Netherlands.
