플랫폼 노동의 정의와 노동권･단결권･사회권 관련 법･제도 비교연구:한국과 유럽연합을 중심으로

초록

21세기의 디지털 플랫폼 노동은 전 세계 노동시장의 주요 변화 중 하나로 부상하였다. 특히, 이러한 변화에 따른 노동권 및 사회권 관련 문제와 제도개혁 과제가 크게 주목받고 있다. 그중 유럽연합 차원의 대응은 개별 국가의 사회적･경제적 맥락과 노동시장 관행을 고려하면서도 플랫폼 노동 관련 법･제도의 위치를 총체적으로 파악할 수 있게 하는 기본적 기준으로 작용하기 때문에, 유럽연합과 한국의 법･제도 비교연구는 플랫폼 노동의 보호를 위한 한국의 법･제도의 상황을 총체적으로 파악하게 하고 진단하게 한다는 의의가 있다. 이에 본 연구는 먼저 유럽연합 차원에서 제시하는 플랫폼 노동의 정의, 그리고 유럽국가의 플랫폼노동의 규모와 현황을 살펴보며, 유사한 기준으로 한국 플랫폼 노동의 규모와 특징을 새롭게 추정한다. 이어 플랫폼 노동을 위한 법･제도적 보호장치가 어떤 형태로 작동하는지, 플랫폼 노동자의 권리보장 문제에 주목하며 한국과 유럽연합의 노동법, 노동조합법, 사회보장법에 대한 비교연구를 수행한다. 본 연구의 디지털 플랫폼 노동의 정의 및 법･제도 비교연구 결과는 플랫폼 노동뿐만 아니라 비정형적 모습의 새로운 형태로 일하는 모든 노동자의 권리 보장을 위한 법･제도 개선과제에 함의를 줄 수 있다.

Abstract

Digital platform work in the 21st century has emerged as one of the major changes in the global labour market. In particular, labour rights and social rights issues and institutional reforms have received significant attention. Since the European Union's legislative directive serves as a basic reference for the overall position of the legal and institutional framework for platform labour while taking into account the social and economic context and labour market practices of each country, a comparative study of the EU's legislative directive and Korea's legal and institutional framework is significant in that it provides a holistic view and diagnosis of Korea's legal framework for the protection of platform labour. First, this study examines the definition of platform work proposed by the European Union and the scale and status of platform work in European countries, and uses similar criteria to estimate the scale and characteristics of platform labour in Korea. Then, it conducts a comparative study of Korean and EU labour laws, trade union laws, and social security laws, focusing on how legal and institutional protections for platform work operate and secure the rights of platform workers. The findings of this study on the definition of digital platform labour and the comparative legal system may have implications for improving the legal system to ensure the rights of not only platform workers but also all workers working in new forms of nonstandard work.
