재판매가격유지제도(도서정가제)에 관한 신제도론적 고찰

저작물재판매가격유지제도(도서정가제)는시장 기구를 통한 판매업자의 사업활동에서 기본적인 사항인 판매가격의 자유로운 결정을 구속하는 것이다. 공정거래 정책 차원에서 이러한 행위는 공정한 경쟁을 저해하므로 딩연위법이라고 판단하는 경향이 높다 공정거래위원회는그동안 공정거래법 시행령 부칙에 재판매가격유지행위가인정되는 저작물 범위(도서정가제) 설정기한을 2002년 12 월 31 일로 정한 후 2003년 1 월 1 일부터 재판매가격유지행위가 허용되는 저작물의 범위를 고시하였다. 그러나 공정거래위원회의 현행 고시조치는 소비자인 독서인들을 위한 제도의 설계 즉 재판매가격유지행위 금지에 초점을 두어야 함에도 불구하고 이익집단인 출판업자들의 강한 요꿰 부딪혀 소비자를 위한 재판매가격유지행위에 대한 보다 더 효과적인 제도설계를 제공하지 못하고 있다고 본다. 그 결과 소비자인 독자들의 도서 선택기회를 박탈하여 소비자 후생을 감소시킴은 물론 공정하고 자유로운 저작물 유통 경쟁 질서를 저해할 가능성이 높다. 이러한 배경 하에 본 연구는 제도분석틀하에 저작물에 대한 재판매가격유지행위에대한 이론적 기초， 저작물 재판매가격 유지행위에 관련된 현행 법 · 고시의 현황 및 문제점， 한국 및 외국의 출판산업 유통구조 실태 및 외국의 저작물재판매가격유지제도의 시사점을 도출하여 현행 공정거래법상의 재판매가격유지행위 허용범위 규칙을 새롭게 재정비(전문 · 학술도서)하여 소비자인 독자의 후생을 증대하는데 그 목적이 있다.
Abstract
Resale Price Maintenance(RPM) on publications is to fix the maximum book price by book publishers against the free sale price decision of booksellers through the market mechanism. In principle, the Fair Trade Law(FTL: The Korean Antitrust Law) restricts the RPM activity due to the hinderance of fair and free competition. No enterprise shall engage in a RPM; provided that this shall not apply to the case where there exist justifiable reasons in terms oj the maximum price maintenance preventing the transactions oj commodities or services in excess oj specified prices(FTL Article 29: 1). In the meanwhile, the Fair Trade Commission(FTC) has temporarily permitted the activity exceptionally to all types of book publishers. Since January 1st, 2003, however, the FTC has announced the permissible scope of the RPM through three periods(l/1/2003 -12/31/2004; 1/1/2005 -12/3 1/2006; 1/1/ 2007 -). The critical issue is that the permissible scope of FTC is too broad. The broad FTC's scope decision of RPM is against the book consumers' rights to choose the books with discount price through the market competition. The purpose of this paper is threefold. Firstly, the theoretical framework of the RPM on publications is established under the New Institutionalism. Secondly, the current Korean conditions and problems of RPM on publications are investigated with the implications of book distribution system and RPM of OEeD countries. Finally, some new institutional arrangements of permissible RPM scope are recommended to promote consumer welfare and demand(market testing services).
