Abstract

International law on the prohibited use of force has been established and developed. Nevertheless, there is a ‘gray zone’ due to the uncertainty of the concept of use of force and self-defense against ‘armed attack’ which is sever form of use of force. This ‘gray zone’ is expanding gradually with the development of science and technology today. In particular, the method of attacking other countries and the effective target of ‘use of force’ is different from the past and has been expanded in various ways due to the development of ICT and the changes in the industrial structure. The prohibition of the use of force under international law, the normative cornerstone of international peace and security should continue to be improved in the direction of clarification, refinement, realization, and strengthening of binding power. Given the global nature of cyber activities, the international community must agree on universal jurisdiction to exercise jurisdiction in all countries for cyber operations as a crime or international offense. Considering the concealment and ambiguity of cyber operations, and the technical expertise necessary for the judgment on the operations, it is necessary to establish an international professional organization dedicated to the fact finding and conciliation for the cyber operation disputes. It is necessary to secure standards that have specific validity by focusing on hybrid wars in which military means and all non-military means including cyber operations rather that to add supplementary norms to the prohibition on use of force by focusing excessively on cyber operations. To ask international responsibilities more firmly, the ILC draft of 2001 should be supplemented and adopted as an international convention as soon as possible by reflecting the characteristics of cyber illegal activities. Also to restrict or punish cyber operations that do not meet the threshold of ‘armed attack’, but meet that of the use of force, the United Nations Security Council need to establish substantial and unambiguous guidelines.
