Abstract
Although AI-generated inventions cannot be regarded as being implemented in reality, it can be said to be predictable inventions in the near future. While it has become specific that AI cannot become an inventor on its own according to the recent decisions to reject DABUS patent application by major Patent Offices, whether the resulting inventions are patent eligible and, if they are, who and why should be named as an inventor is not clear. As AI becomes more commonly involved in the inventive process, patent applicants have a growing need for clear rules. Therefore this paper deals with the issues of the patent-eligibility and inventorship of AI-related invention. Inventors have generally used tools throughout the inventive process, and reliance on tools historically has not affected the validity of the resulting invention. In particular, the use of computers as tools in the inventive process has a long history. There would be no grounds to invalidate the invention or to consider it differently just because AI contributed to the conception more than the existing computer. Because advancements in technology could make it possible for computer systems to contribute to the conception more than human in the near future, someone casts doubt as to the inventorship of AI inventions. However, it should be considered that human contributions implemented in other way than before, rather than smaller. For example, as AI becomes more sophisticated, human roles will increasingly be limited to identifying basic problem structures and evaluation criteria for outcomes, and AI will dominate the rest of the invention process. The fact that human contributions differ due to advancing tools should not be a factor to deny patent-elibility of the invention, but referred to as a new standard for determining the non-obviousness requirement. The identification of a human inventor who have substantially contributed to the conception of the invention is expected to become more complex as technology advances. In particular, individuals who invent using AI will arrive at a desired solution in a way that does not fully consistent with the conventional conception by a human-being. This paper categorizes various levels of AI intervention and examines methods for identification of human inventors through analysis of cases corresponding to each category.
