Abstract

This paper analyzes the legal issues surrounding inventorship for artificial intelligence (AI) through the lens of the DABUS AI case. In many jurisdictions, the inventor status of AI is denied, as current laws recognize only natural persons as inventors. This analysis is based on the operating principles of AI, such as artificial neural networks and algorithms, and WIPO's classification of AI inventions (distinguishing between "AI assisted" and "AI generated" inventions). These concepts are examined in light of the requirements for an invention's establishment under patent law and the legal doctrine of inventorship. The paper argues that AI-driven creations face difficulties in meeting the "inventive step" requirement, making their recognition as formal inventions challenging. Since AI is essentially a tool that produces algorithm-based outputs, its contribution does not warrant inventor status, even when it is instrumental in the inventive process. In conclusion, the paper suggests that under the current legal framework, a human is deemed the inventor in the case of AI-assisted inventions. Conversely, for inventions generated solely by AI, there are fundamental limitations to their very recognition as inventions under existing law. This indicates that a comprehensive review of the matter is necessary.
